Lam Dong Alumina Factory at risk of stopping operations due to lack of input materials

On September 22, information from the People's Committee of Lam Dong province, the unit has just issued a document assigning the Department of Natural Resources and Environment to preside over and coordinate with the Departments of Construction, Agriculture and Rural Development, Finance, Bao Lam District People's Committee and relevant agencies and units to urgently review and handle difficulties and problems in compensation and site clearance at the Lam Dong Bauxite - Aluminum Complex project, as requested by Lam Dong Aluminum One Member Co., Ltd. and report to the Provincial People's Committee the implementation results before October 10, 2024.

According to the report of Lam Dong Aluminum Company, the 5-year bauxite mining area (phase 3), the Lam Dong Bauxite - Aluminum Complex project was approved by the Provincial People's Committee for the boundary scope, the land acquisition area for mining has a total area of ​​over 428 hectares. Since its implementation to date (from the beginning of 2024), 73.3 hectares have been decided by the People's Committee of Bao Lam district on compensation, support for site clearance and land acquisition. However, the exploitation capacity is only about 40 hectares due to the concentrated area, the remaining area cannot be exploited because it is scattered and has no access road.

Previously, the compensation and site clearance work in phase 2 also encountered many difficulties: 10 households have not received money, 4/10 households are subject to resettlement so they are not eligible for enforcement, 6/10 households have transferred their files to the District to carry out enforcement procedures according to regulations but up to now the District has not issued any documents on this matter. There is 01 household in phase 3 (10th time) of 0.61ha who did not agree with the price so they have not received compensation.

In particular, there are 14.2 ha/29.9 ha of land clearance origin disputes between the people and the two companies Vinh Tien and Vinh Loc that need to continue to be verified and clarified (of which: 6.5 ha of people are disputing the right to clear and cultivate with the two companies; the remaining part is common traffic land and a part of the land needs to continue to be verified and clarified about its origin).

Therefore, according to calculations, the remaining accessible land fund can only meet aluminum production until September 25, 2024. After this point, if no additional land fund is added, the aluminum factory will have to reduce the load or stop operations. This affects the unit's 2024 production and business plan as well as the jobs of nearly 1,400 employees at the Company.

Currently, the work of preparing compensation and site clearance support plans is being suspended because the People's Committee of Lam Dong province and the People's Committee of Bao Lam district have not yet issued documents and decisions on instructions and unit prices of all types to apply appropriately according to the Land Law 2024.

In order to promptly meet the urgent need for raw materials for production, Lam Dong Aluminum Company has sent a document proposing to the Provincial People's Committee and departments and branches to quickly issue decisions and guiding documents to replace old decisions under the 2013 Land Law that are no longer appropriate, such as: Detailed regulations on a number of contents on compensation, support, and resettlement when the State recovers land; price list of houses, construction works and prices of composite components; prices of crops; prices of land types in the period 2020 - 2024.

Lam Dong Aluminum Company also proposed that, based on the new documents and decisions issued under the 2024 Land Law of Lam Dong province mentioned above, the People's Committee of Bao Lam district issue decisions on replacement unit prices; including unit prices of components and architectural objects not included in the price list; land price adjustment coefficient to determine specific land prices and compensation when the State reclaims land to carry out phase 3 bauxite mining.

At the same time, propose the District People's Committee to direct departments, offices, and units to carry out procedures for notifying land recovery, hold meetings with people to notify land recovery; issue decisions and enforce land recovery for 6 households that have not received money (4.8 hectares).
