On November 29, the Ho Chi Minh City People's Court announced the verdicts for 15 defendants in the case involving Xuyen Viet Oil Trading and Transportation Company Limited and related entities.
The court sentenced defendant Do Thang Hai (former Deputy Minister of Industry and Trade ) to 3 years in prison for the crime of accepting bribes.
For the crime of accepting bribes, the court sentenced defendant Nguyen Loc An (former Deputy Head of the Department of Information and Communications Technology - Ministry of Industry and Trade) to 4 years in prison; Tran Duy Dong (former Head of the Department of Information and Communications Technology) to 7 years in prison; Hoang Anh Tuan (former Deputy Head of the Department of Information and Communications Technology) to 7 years in prison; Dang Cong Khoi (former Deputy Director of the Price Management Department - Ministry of Finance ) to 2 years in prison; Le Duy Minh (former Director of the Ho Chi Minh City Tax Department) to 6 years in prison; and Phan Kien Anh (former Director of the Nghi Son oil refinery branch) to 4 years in prison.
The defendant, Do Thang Hai, is a former Deputy Minister of Industry and Trade.
The court ruled that defendant Do Thang Hai, along with several other officials from the Ministry of Industry and Trade, had received bribes from the owner of Xuyen Viet Oil Company to grant licenses for the import and export of petroleum products.
Despite knowing that Xuyen Viet Oil Company did not meet the requirements for trading petroleum products and failing to conduct an on-site inspection, Mr. Nguyen Loc An still submitted a proposal to his superior, Mr. Do Thang Hai (Deputy Minister of Industry and Trade), requesting approval of the license. During his meetings with the owner of Xuyen Viet Oil Company, Mr. An received bribes from her.
According to the indictment, the officials received bribes in the following amounts: Do Thang Hai received $50,000 (approximately 1.11 billion VND); Tran Duy Dong received $250,000 (over 5.6 billion VND); Nguyen Loc An received 400 million VND and a Patek Philippe watch; and Hoang Anh Tuan received $265,000 (nearly 6 billion VND).
The court determined that the defendants' actions constituted bribery involving an amount exceeding one billion VND, requiring strict punishment. However, regarding Mr. Hai, the receipt of money from the owner of Xuyen Viet Oil Company was considered to have occurred passively, more than a month after he signed the re-issuance of the license to this company.
Previously, Xuyen Viet Oil Company had been licensed to operate and was one of the major suppliers of petroleum products to the southern region. In the context of the COVID-19 pandemic, petroleum products were considered essential commodities, so Mr. Hai agreed to reissue the license to Xuyen Viet Oil. The amount of money he received was also less than that of the other defendants.
The court sentenced defendant Mai Thi Hong Hanh (Director and Chairwoman of the Board of Directors of Xuyen Viet Oil) to 19 years in prison for violating regulations on the management and use of state assets causing losses and waste, and 11 years in prison for bribery. The combined sentence is 30 years in prison. Additionally, the defendant is banned from operating in the petroleum business for 2 years.
Defendant Nguyen Thi Nhu Phuong (former Deputy Director of Xuyen Viet Oil) was sentenced to 6 years in prison for violating regulations on the management and use of state assets, causing losses and waste.
The court sentenced defendant Le Duc Tho (former Secretary of the Ben Tre Provincial Party Committee) to 15 years in prison for bribery and 13 years in prison for abusing his position and power to influence others for personal gain. The total sentence is 28 years in prison.
The remaining defendants were sentenced to terms ranging from 1 year and 6 months of suspended imprisonment to 7 years in prison for the crimes of accepting bribes and giving bribes.
