Several new points in the policy regarding early retirement.

According to the Ministry of Interior , one objective of Decree 177/2024/ND-CP issued today (December 31) is to promptly develop appropriate policies to recognize the work process and contributions of officials who are not old enough to be re-elected but wish to retire, contributing to improving the effectiveness and efficiency of personnel management.


This afternoon, December 31st, at an impromptu press conference organized by the Ministry of Interior, Mr. Nguyen Tuan Ninh, Director of the Department of Civil Servants (Ministry of Interior), provided some noteworthy information about the new points in Decree No. 177/2024/ND-CP, which was just issued by the Government today. This decree regulates the regime and policies for cases of non-re-election, re-appointment, and for officials who resign or retire voluntarily. The decree will take effect from January 1st, 2025.

According to the Director of the Department of Civil Servants, in fulfilling the task assigned by the Government Party Committee in Document 2969-CV/BCSĐCP and the instructions of the Standing Deputy Prime Minister Nguyen Hoa Binh, the Ministry of Interior has urgently drafted a Decree to replace Decree No. 26/2015/ND-CP following a streamlined procedure to promptly issue policies serving the Party Congresses at all levels leading up to the 14th National Congress of the Party.

The objective of Decree No. 177/2024/ND-CP dated December 31, 2024, is to promptly institutionalize the Party's guidelines and policies on implementing regimes and policies for cadres after Party Congresses at all levels and cadres under the management of the Politburo and the Secretariat who are granted leave of absence or retirement by competent authorities in accordance with Conclusion Notice No. 20-TB/KL dated September 8, 2022, of the Politburo.

At the same time, appropriate policies should be developed to encourage and recognize the work and contributions of officials who are not old enough to be re-elected but wish to retire; and to address obstacles and shortcomings in the implementation of policies, thereby contributing to improving the effectiveness and efficiency of personnel management.

Notably, this Decree specifies three groups of beneficiaries. Firstly, those who are not old enough to be re-elected (less than 30 months remaining from the time of the congress to the time of retirement), including: officials holding full-time positions and titles elected (Clause 1, Article 2); the regulations remain the same as Decree 26/2015/ND-CP, while adding a provision that this group includes officials specified in this clause, applicable even to cases where officials meet the age requirements for re-election to Party committees but are not old enough to be re-elected to leadership positions in the government, Vietnam Fatherland Front, or socio-political organizations at the time of the election or congress at the same level to elect those positions.

The addition of regulations aims to address practical difficulties and obstacles, specifically the fact that the timing of congresses held by various agencies has led to cases where individuals are old enough to be re-elected to their current agency or organization but not old enough to be re-elected to the Party committee. Consequently, these individuals will also be subject to the early retirement or termination of employment scheme.

Officers and professional soldiers in agencies and units under the People's Army and the People's Police holding positions and titles within the structure of participating in Party committees and full-time members of the Inspection Committee at the same level (Clause 2, Article 2); this is added to the scope of application of the Decree to reform administrative procedures, so relevant agencies do not need to issue guiding documents for implementation but can implement it immediately upon the Decree's issuance, resolving cases within the armed forces immediately.

Civil servants holding fixed-term appointments whose positions fall within the structure of participation in the Party committee at the same level (Clause 3, Article 2). This is supplemented to address practical difficulties, whereby some positions and titles within the state sector (civil servants) are subject to the requirement of being old enough to be re-elected to the Party committee.

Secondly , the group still eligible for re-election (from 30 months to 60 months): cases where individuals have between 30 and 60 months of service remaining from the date of the Congress, and are therefore eligible for retirement but wish to retire due to personnel arrangements within the Party Committee, and this is approved by the competent authority (Clause 4, Article 2); supplementing regulations in accordance with the Politburo's policy, according to which, for cases of voluntary resignation or early retirement, there will be a mechanism to encourage and facilitate early retirement.

Thirdly , the group of officials under the management of the Politburo and the Secretariat.

Officials under the management of the Politburo and the Secretariat of the Central Committee may be granted leave of absence or retirement by competent authorities in accordance with Conclusion Notice No. 20-TB/KL dated September 8, 2022, of the Politburo (Clause 5, Article 2).

At the same time, regulations were added in accordance with the Politburo's directives, creating a legal basis for resolving cases where individuals under the Politburo and Secretariat's management commit violations and are granted early retirement or termination by competent authorities; regulations were also added to allow for the application of a system for individuals who are not subject to disciplinary action but wish to resign or retire early.

Additionally, regulations are in place to address cases of individuals who resigned or retired before the effective date of this decree, resolving difficulties faced by some individuals who resigned or retired recently.

Regarding regulations and policies, the Director of the Department of Civil Servants and Public Employees stated that this Decree stipulates two specific policies: early retirement and leave of absence pending reaching the retirement age.

Specifically, the policy of continuing to work until retirement age should be abandoned to address the practical issue that makes it difficult to arrange and assign positions for many individuals who are not old enough to be re-elected but choose to remain in their jobs; instead, the policy should encourage individuals to retire immediately.

The regulations and policies applied to those who are not old enough to be re-elected but retire early are higher than those stipulated in the current Decree, based on the principle of being higher than those for downsizing the workforce. Specifically, the average pension for the first 20 or 15 years of employment with social insurance contributions is increased from 3 months to 5 months; from the following year onwards, they are entitled to 0.5 months' salary per year of social insurance contributions; there is no reduction in pension rate for the period of early retirement; and the average pension for each year of early retirement is increased from 3 months to 5 months' current salary.

According to Mr. Nguyen Tuan Ninh, during the drafting process of this Decree, units within the Ministry of Interior closely coordinated to ensure that the policies and regulations issued by the Government were implemented in the context of focusing on streamlining the organizational structure of the political system. Therefore, the Decree stipulates that "in cases where the subjects specified in Article 2 of this Decree are also subject to policies and regulations in the implementation of organizational restructuring, they may choose to receive the higher policy and regulations" in Clause 4, Article 7.
