(PLVN) - The Department of Food Safety - Ministry of Health said that after a period of collecting opinions from Ministries, branches, People and relevant units under the Ministry on the proposal to build a revised Law on Food Safety, many opinions have been sent to the Department.
Accordingly, 13 Ministries and ministerial-level agencies basically agreed with the dossier. For units of the Ministry of Health, 10 units sent comments, of which 4 Departments and Bureaus agreed with the draft and had no additional comments. 6 Departments and Bureaus basically agreed with the draft and had additional comments, revisions and additions. For enterprises, 16 units sent comments. The rest were comments from the people.
Previously, the Food Safety Department (FSD) said that the Ministry of Health is proposing to develop a revised Food Safety Law to meet new requirements, resolve practical difficulties, and perfect the legal system on food safety. The Food Safety Law took effect on July 1, 2011, with many new, groundbreaking regulations. After more than 12 years of implementation, the Food Safety Law and its detailed decrees and current regulations on food safety in commercial activities have created a positive legal corridor for domestic and international food business activities.
However, up to now, the 2010 Food Safety Law has contents and regulations that are no longer suitable to the requirements of building and perfecting the legal system on food safety as well as socio- economic conditions.
Firstly, some regulations and certification of conformity on conformity declaration for food products are not suitable to reality (period 2010 - 2017) because the number of food products is large but the number of national technical regulations is small; production and business conditions are not close to small-scale production households.
Second, there is a lack of management regulations such as: Regulations on food safety indicators for foods of plant origin are still lacking and not consistent with the current situation; regulations on decentralization in food poisoning investigations; regulations on revocation of Certificates of Conformity Declaration/Registration of Product Declarations have not yet issued local technical regulations on the quality of clean water used for domestic purposes... Because the field of food safety is broad and related to many regulations of many different legal documents, some regulations guiding the Food Safety Law are not consistent.
Third, some concepts are still missing such as small-scale food production and trading, pre-packaged processed food; there is no consistency between laws such as the concepts of "food production" and "food business" are not consistent between the 2020 Enterprise Law and the Food Safety Law; the concepts of "prohibited use", "list of permitted use", "not yet permitted to use", "not yet permitted to circulate in Vietnam" ... have not been unified and clearly explained in standards and regulations to ensure consistency in the implementation of the Food Safety Law.
Fourth, some regulations are not yet consistent and difficult to implement, such as Clause 1, Article 36 of the Food Safety Law, which stipulates the application for a Certificate of food safety qualified facility, which stipulates that the application must include "Certificate of training in food safety knowledge of the facility owner and of the person directly producing and trading food according to the regulations of the Minister of the Ministry managing the industry"; Clause 1, Article 10 of Decree 17/2020/ND-CP stipulates "The person directly producing must be trained in food safety knowledge and confirmed by the facility owner". However, the documents guiding the Food Safety Law have not clearly specified the authority and responsibility of which agency to conduct food safety knowledge training. Assigning businesses and individuals to organize training does not ensure objectivity and effectiveness in law enforcement...
The Ministry of Health said that in order to implement the Party and State's policy on perfecting the institution of food safety management, in response to new requirements of practice and international integration, and to overcome shortcomings and inadequacies arising in the implementation of the Food Safety Law, it is necessary to develop a Law amending and supplementing a number of articles of the Food Safety Law on the basis of promoting the advantages and overcoming the limitations of this Law.
