USA Today, citing senior officials in President Donald Trump's administration, reported that he is expected to sign an executive order to dissolve the Department of Education on March 20 (local time), fulfilling a promise he made during his campaign for a second term.
Accordingly, he will direct Education Secretary Linda McMahon to take "all necessary steps to facilitate the closure of the Department of Education and return educational authority to the states," according to the White House summary of the draft executive order.

Observers believe that Trump's executive order will almost certainly face legal challenges from opponents. The move will also pose a new test of the president's powers, after his administration's attempt to shut down the U.S. Agency for International Development (USAID) was blocked this week by a federal judge in Maryland.

The U.S. Department of Education was established by Congress as a cabinet-level agency in 1979 and will not be immediately shut down by Trump's executive order. Complete elimination would require congressional approval.
Despite President Trump's significant cuts to the Department of Education's workforce in recent weeks, the agency remains in existence and continues to oversee crucial federal funding programs for schools.
Last week, more than 1,300 Department of Education employees received notices of termination. Republicans have long argued that the federal government has too much power over local and state education policy, despite not controlling the curriculum.
White House Deputy Press Secretary Harrison Fields said Trump's executive order "will empower parents, states, and communities to control and improve outcomes for all students."
He said recent scores on the National Assessment for Educational Progress (NAEP) "expose a national crisis – our children are falling behind."
