On January 16, the legal team of South Korean President Yoon Suk Yeol filed a complaint alleging that the head of the police and anti-corruption agency had illegally entered the presidential residence.
Yonhap reported that Yoon's legal team has filed complaints against Oh Dong-woon, Director of the Korea Senior Officials Corruption Investigation Office (CIO), Woo Jong-soo, Director of the Korea National Investigation Office (NOI), and several other individuals.
The lawyers accused the named individuals of illegally entering the presidential residence and carrying out an arrest warrant for Mr. Yoon, alleging that these actions constituted rebellion, obstruction of duty, and violation of military secrets. Korean law designates the presidential residence as a military secret facility.
TV in South Korea broadcast news that President Yoon Suk Yeol had been arrested on January 15.
"They mobilized more than 3,700 police officers to storm the residence and arrest the president, violating the provisions of the criminal procedural law," Yoon's lawyer argued.
Also on January 16, the Seoul Central District Court began reviewing the legality of the arrest warrant for President Yoon Suk Yeol. After CIO investigators arrested him on January 15 to investigate allegations of rebellion stemming from his decision to declare martial law in early December 2024, the president's lawyers filed a motion with the court requesting a review of the decision.
During the review process, the 48-hour detention period for Mr. Yoon was postponed from approximately 2 PM on January 16th (local time) when investigators submitted documents to the court. The postponement lasted until the court returned the case file to the investigating agency. On the second day of questioning (January 16th), the lawyers stated that President Yoon did not appear due to health issues and had clearly explained his position on January 15th, even though Mr. Yoon had previously requested that the questioning be rescheduled from morning to afternoon.
Mr. Yoon's side opposes the CIO's investigation, arguing that the agency lacks jurisdiction, while the CIO emphasizes that the court's approval of the detention order confirms its authority.
