On the afternoon of December 4, the National Assembly listened to the Presentation and Report on the review of the draft Resolution on the mechanism and policy for national energy development in the 2026-2030 period. The development of the Resolution aims to remove obstacles, create breakthroughs for important energy projects, ensure energy security and meet the country's sustainable development requirements in the new period.
Focus on removing institutional bottlenecks and promoting key energy projects
Presenting the Report to the National Assembly, Minister of Industry and Trade Nguyen Hong Dien said that the issuance of the Resolution is necessary to promptly resolve institutional, mechanism and policy bottlenecks that are hindering the progress of large-scale energy projects. The highest goal is determined to ensure solid national energy security, serving socio-economic development in the 2026-2030 period and sustainable development goals.
The Draft Resolution consists of 8 Chapters and 24 Articles, focusing on specific mechanisms to unlock resources and create a unified legal corridor for implementing energy projects. The content covers key areas such as adjusting power development planning; plans for developing power transmission/distribution networks; investment mechanisms for power project construction; offshore wind power development; direct electricity trading; investment in oil, gas and coal projects and national petroleum reserve policies.
The resolution also clearly stipulates the principles of flexible planning adjustment and the responsibility of the Ministry of Industry and Trade in guiding the documents, procedures and authority for adjustment. Some power grid projects are proposed to apply a mechanism to replace the decision on investment policy approval, in order to shorten the preparation time and speed up the implementation progress.
Clarifying mechanisms related to planning and investment procedures
Reviewing the Report, Chairman of the Economic and Financial Committee Phan Van Mai said that the Committee basically agreed with the necessity of issuing a Resolution to concretize Resolution No. 70-NQ/TW of the Politburo on national energy development. This is a key requirement to meet the country's goal of rapid and sustainable development in the new period.
The Committee recommends that the draft be carefully reviewed, only regulating issues under the authority of the National Assembly, avoiding including contents under the authority of the Government, ministries, branches or localities to issue sub-law documents. This is to ensure consistency with the spirit of innovation in law-making as stated in Resolution No. 66-NQ/TW.
The Government is requested to explain more clearly the new mechanisms to ensure feasibility and avoid risks during implementation.
The review report clearly stated a number of contents that need to be fully explained by the Government. Among them is the proposal to exempt investment approval procedures for power grid projects included in the Power Planning or the power supply network plan of the Provincial Planning. However, according to the draft Law on Planning (amended), these plans are orientational in nature and do not list specific projects. Therefore, the determination of whether a project is included or not included in the planning needs to be clarified to ensure reasonableness and feasibility.
Regarding the proposal to use the planning approval decision to replace the investment policy approval document, the Committee recommends careful assessment to avoid conflicts with the new approach of the Law on Planning (amended), which focuses on orientation and does not identify a specific list of projects.
Regarding the mechanism for directly assigning certain projects to ensure progress, the Economic and Financial Committee proposed to clearly define the conditions and criteria for application to ensure that this special mechanism is used for the right purpose.
Setting criteria also helps to clearly distinguish between projects that are directly assigned and projects that are required to bid to select investors according to the normal process.
Mechanisms related to offshore wind power, oil and gas, power grids and petroleum reserves need to be reviewed synchronously, ensuring their suitability with the implementation capacity of ministries, branches, localities and enterprises, while ensuring risk control in practice.
