New regulations on the management and use of foreign aid funds.

VTV.vn - The Ministry of Industry and Trade has just issued Decision No. 3135/QD-BCT on the Regulations on the management and use of foreign aid funds under the Ministry's management authority.

Accordingly, the regulations stipulate the procedures for soliciting funding, drafting, appraising, approving, and signing international treaties and agreements on foreign funding, as well as organizing, implementing, monitoring, and evaluating programs, projects, and activities using foreign funding under the management authority of the Ministry of Industry and Trade .

Foreign funding referred to in this Regulation includes official development assistance (ODA) and concessional loans from foreign donors falling within the scope of Decree No. 242/2025/ND-CP, and non-refundable grants not classified as official development assistance from foreign agencies, organizations, and individuals to Vietnam falling within the scope of Government Decree No. 80/2020/ND-CP.

This regulation applies to agencies and units under the Ministry of Industry and Trade, Steering Committees, Project Management Boards, and organizations and individuals involved in projects using foreign-funded capital under the management authority of the Ministry of Industry and Trade.

Programs and projects using ODA and concessional loans must be consistent with the sectoral development strategy, medium-term and long-term plans; and consistent with the functions, tasks, needs, and capacity to receive capital, technology, management experience, and utilization of funding of the proposing unit.

In addition, units under the Ministry are responsible for leading or coordinating with relevant units in planning the mobilization of foreign funding for the industry and trade sector. The Ministry of Industry and Trade assigns the Planning Department and the Finance and Enterprise Management Department as the focal points to coordinate with units under the Ministry to compile a general report on the implementation of funding.

The implementation of ODA and concessional loan projects includes the preparation and approval of master plans, the organization of bidding processes, contractor selection, contract signing, and monitoring of progress and quality. Project-owning units are directly responsible for the entire process.

For non-refundable grants, the recipient unit is responsible for fully complying with current regulations regarding approval procedures, implementation, and reporting of results.

This regulation takes effect from the date of signing and replaces Decision No. 305/QD-BCT dated February 15, 2019 of the Minister of Industry and Trade on promulgating the Regulation on the management and use of foreign capital under the management authority of the Ministry of Industry and Trade.
