Accordingly, the regulations stipulate the mobilization of funding, development, appraisal, approval, signing of international treaties and agreements on foreign funding, organization of implementation, monitoring and evaluation of programs, projects and activities using foreign funding under the management authority of the Ministry of Industry and Trade .
Foreign funding mentioned in this Regulation includes official development assistance (ODA) capital and preferential loans from foreign sponsors within the scope of Decree No. 242/2025/ND-CP and non-refundable aid sources not belonging to official development assistance from foreign agencies, organizations and individuals for Vietnam within the scope of Decree No. 80/2020/ND-CP of the Government .
The Regulations apply to units under the Ministry of Industry and Trade, Steering Committees, Project Management Boards and organizations and individuals related to projects using foreign funding under the management authority of the Ministry of Industry and Trade.
Programs and projects using ODA capital and preferential loans must be consistent with the industry development strategy, medium-term and long-term plans; consistent with the functions, tasks, needs and capacity to receive capital, technology, management experience and use of funding of the proposing unit.
At the same time, the units under the ministry are responsible for presiding over or coordinating with relevant units in planning to mobilize foreign funding sources for the industry and trade sector. The Ministry of Industry and Trade assigns the Department of Planning, the Department of Finance and Enterprise Management to be the focal points to coordinate with the units under the ministry to synthesize the general situation of funding implementation.
The implementation of ODA and concessional loan projects includes the preparation and approval of master plans, organizing bidding, selecting contractors, signing contracts, and monitoring progress and quality. Project owners are directly responsible for the entire process.
For non-refundable aid, the aid recipient is responsible for fully implementing approval procedures, implementing and reporting implementation results according to current regulations.
This Regulation takes effect from the date of signing and replaces Decision No. 305/QD-BCT dated February 15, 2019 of the Minister of Industry and Trade on promulgating the Regulation on management and use of foreign capital under the management authority of the Ministry of Industry and Trade.
