New regulations on documents, procedures, and processes for labor registration.

The government has just issued Decree No. 318/2025/ND-CP dated December 12, 2025, which details some provisions of the Employment Law regarding labor registration and the labor market information system.

The Decree, comprising 4 chapters and 25 articles, regulates labor registration and the labor market information system in accordance with several provisions of the Employment Law No. 74/2025/QH15. Specifically: it regulates labor registration information and the database on workers; regulates the dossier, procedures, and locations for labor registration; regulates the receipt, management, exploitation, connection, sharing, and use of the database on workers (Clause 6, Article 17 of Law No. 74/2025/QH15); and the labor market information system and labor market information (Clause 3, Article 19 and Clause 3, Article 20 of Law No. 74/2025/QH15).

The Decree stipulates three groups of individuals eligible for labor registration: Workers subject to mandatory social insurance as prescribed in Clause 1, Article 2 of the Social Insurance Law No. 41/2024/QH15; workers who are currently employed but not subject to mandatory social insurance; and unemployed individuals who are currently without work, seeking employment, and willing to work.

Officials, civil servants, public employees, and members of the people's armed forces who fail to register or update their labor registration information as prescribed in this Decree.

Workers are responsible for self-declaring their labor registration records and are legally accountable for the truthfulness and accuracy of the information declared; employers are responsible for collecting, declaring, and providing complete, accurate, and timely information about workers when recruiting, changing, or terminating labor relations as stipulated in this Decree; and ensuring the truthfulness and accuracy of the information provided.

The decree stipulates that the information required for employee registration includes: Basic information of the employee, including: Surname, middle name and given name; personal identification number; date of birth; gender; ethnicity; current address (permanent or temporary residence).

This group of information covers general education , vocational education, higher education, vocational skills certificates, and other certifications, including: Information on the highest level of general education achieved; information on the level and field of training achieved in vocational education and higher education; information on national vocational skills certificates achieved; and other certifications.

The group of information on employment status and employment needs includes: Information on current employment, including: job title, occupation, contract type, and workplace; information on employers, including: employer name, code number, type of employment, head office address, and economic sector; information on unemployment status, including: duration of unemployment and reason for unemployment; and information on employment needs, which includes desired employment, such as: occupation, contract type, salary and benefits, and workplace.

The information group regarding social insurance and unemployment insurance includes: Information on the status of participation in social insurance and unemployment insurance contributions, including: social insurance number, type, and category of social insurance. Information on the status of receiving social insurance and unemployment insurance benefits, including: benefit type and duration of benefits.

The group of information on characteristics and specifics includes: Information on people with disabilities; information on people belonging to poor households, near-poor households, and households whose land has been reclaimed; information on relatives of people who have rendered meritorious services to the revolution; information on people who have completed military service or service in the people's police force.

The Decree stipulates that the labor registration dossier is the Social Insurance Registration Declaration Form as prescribed in Clause 1, Article 27 of Law No. 41/2024/QH15, with the addition of information specified in points a and b, Clause 3, Article 4 of this Decree. The Vietnam Social Insurance is responsible for issuing the Social Insurance Registration Declaration Form.

Employees provide employers with relevant information in the aforementioned Social Insurance Registration Form and are responsible for the accuracy of that information.

Employers register and update employee registration information when submitting applications for registration and updating social insurance participation information as prescribed in the Social Insurance Law and guiding documents.

After being received and processed by the social insurance agency, the employee's registration information is synchronized and shared with the employee database.

The Decree stipulates that the labor registration dossier is an electronic declaration form as prescribed in this Decree. The form of labor registration is online.

Procedure: Workers access the National Job Exchange (https://www.vieclam.gov.vn) or the VNeID electronic identification application, select the registration section, adjust their labor registration information, and fill in the electronic declaration form as prescribed.

The labor registration system receives, processes, and returns successful registration results immediately after the employee completes the electronic declaration form. If registration fails, the system provides feedback on the reason; the employee's labor registration information is updated and synchronized into the employee database.

If workers need to find employment, they can register for job search using the form prescribed in the Government Decree on employment services, either directly at a public employment service organization or online through the National Job Exchange (https://www.vieclam.gov.vn) or via the VNeID electronic identification application.

This Decree shall take effect from January 1, 2026.

The procedures and documentation for registering and updating labor registration information for employees subject to compulsory social insurance will be implemented from July 1, 2026.

The procedures and documentation for registering and updating labor registration information for employed workers who are not subject to mandatory insurance and for unemployed individuals will be implemented from January 1, 2027.
