Regulations on paid extra-curricular teaching and learning activities outside of school

GD&TĐ - Readers asked about regulations on organizing extra teaching and learning activities outside of school that charge students.

I studied pedagogy but could not get a permanent position, so I opened a knowledge training center (already registered and paying taxes). I invited some primary school teachers to join me. I would like to ask, if primary school students ask to take additional cultural training, can I open a class? Is this a violation of Circular No. 29/2024/TT-BGDDT? Huong Le (hwongle***@gmail.com)

If your knowledge training center opens additional teaching and learning activities, it must comply with the provisions of Article 6 of Circular No. 29/2024/TT-BGDDT. Specifically: Organizations or individuals that organize additional teaching and learning activities outside of school with fees from students (hereinafter referred to as additional teaching facilities) must comply with the following requirements: Register for business in accordance with the provisions of law;

Publicly announce on the electronic information portal or post at the location of the tutoring facility the subjects that are organized for tutoring; the duration of tutoring for each subject according to each grade level; the location, form, and time of organizing tutoring and learning; the list of tutors and the tuition fees before enrolling students for tutoring and learning classes.

Teachers who teach outside of school must ensure that they have good moral qualities and professional competence appropriate to the subjects they teach. Teachers who are teaching at schools and participate in teaching outside of school must report to the principal or director or head of the school (collectively referred to as the principal) about the subjects, location, form, and time of participating in teaching.

Opening extra classes as prescribed in Clause 1, Article 2 of Circular No. 29/2024/TT-BGDDT for primary school students is a violation of the provisions in Clause 1, Article 4 of Circular No. 29/2024/TT-BGDDT. In case the center organizes educational activities other than those prescribed in Clause 1, Article 2 of Circular No. 29/2024/TT-BGDDT, it is not subject to application and scope of this Circular.

In case the center is established according to the provisions of Article 42 of Decree No. 125/2024/ND-CP dated October 5, 2024 of the Government regulating conditions for investment and operation in the field of education, it must comply with the provisions of Articles 43, 44, 45, 46, 47 of this Decree.
