Soon issue instructions for implementing Resolution 07, ensuring rights for union officials who have resigned

The Vietnam General Confederation of Labor (VGCL) is urgently implementing a policy to support full-time union officials working under labor contracts to take leave and enjoy new benefits and policies according to Resolution 07 of the Government. Reporters of Tin Tuc and Dan Toc newspaper had an interview with Ms. Ho Thi Kim Ngan, Deputy Head of the Labor Relations Department, VGCL about this issue.

How has the Vietnam General Confederation of Labor addressed the difficulties faced by the group of full-time trade union officials working under contract who lost their jobs due to organizational restructuring but are not eligible for benefits under Policy 178, Madam?

During the implementation of Government Decree 178/2024/ND-CP dated December 31, 2024, on policies and regulations for officials, civil servants, public employees, and members of the armed forces in the restructuring of the political system's organizational apparatus, the Vietnam General Confederation of Labor received feedback from various levels of trade unions requesting that full-time trade union officials working under contract be entitled to the policies stipulated in Decree 178/2024/ND-CP and Decree 67/2025/ND-CP. Therefore, on May 21, 2025, the Vietnam General Confederation of Labor sent a letter to the Ministry of Interior officially proposing the inclusion of full-time trade union officials with professional and technical labor contracts into the group eligible for benefits under Decree 178/2024/ND-CP and Decree 67/2025/ND-CP.

Subsequently, the Standing Committee of the Party Committee of the Vietnam General Confederation of Labor reported to the Party Committee of the Vietnam Fatherland Front and other central mass organizations, and issued a document on continuing to guide the implementation of Decree No. 178/2024/ND-CP, directing localities and sectors: "While awaiting the opinion of the competent authority, agencies and units shall resolve entitlements and policies according to regulations."

At the same time, the Vietnam General Confederation of Labor established a team to study the files of full-time trade union officials who signed professional and technical labor contracts, in order to review and propose solutions for the benefits and policies for this group, within the capabilities and authority of the General Confederation of Labor, abbreviated as Team 3713.

On July 4, 2025, the Politburo issued Conclusion No. 174-KL/TW on a number of tasks to continue building the organization and operation of two-level administrative units to ensure smooth and effective operation. Accordingly, Clause 5 states: “The Vietnam General Confederation of Labor shall preside over and coordinate with the Ministry of Interior to research, advise, propose, and guide the resolution of regimes and policies for full-time trade union officials working under contract (receiving salaries and allowances from trade union funds) affected by the restructuring.”

Immediately after the issuance of Conclusion No. 174-KL/TW, the Vietnam General Confederation of Labor directed its Task Force 3713 to coordinate with the Ministry of Interior to research and propose solutions for addressing the policies and benefits for full-time trade union officials working under contract.

The Standing Committee of the Party Committee of the Vietnam General Confederation of Labor has sent a document to the Party Committee of the Vietnam Fatherland Front and other central mass organizations reporting on the plan to resolve the rights and benefits of full-time trade union officials working under contract, applying Decree No. 178/2024/ND-CP. At the same time, the General Confederation of Labor also submitted Proposal No. 01/TTr-TLD dated July 17, 2025 to the Government requesting the Government to issue a Resolution on the application of Decree No. 178/2024/ND-CP to address the policy for full-time trade union officials working under contract.

Based on the opinion of the Government Office, on July 28, 2025, the Vietnam General Confederation of Labor held a meeting with representatives from the Central Organizing Committee, the Government Office, the Ministry of Interior, the Ministry of Finance, and the Ministry of Justice to provide feedback and discuss the plan to be submitted to the Government. All opinions at the meeting suggested "reconsidering and recalculating the proposed plan to be lower than the severance pay policy stipulated in Decree No. 178/2024/ND-CP".

On August 1, 2025, the Standing Committee of the Party Committee of the Vietnam General Confederation of Labor sent a document to the Party Committee of the Vietnam Fatherland Front, central mass organizations, and to the Ministry of Finance and the Ministry of Justice to request opinions on the draft submission to the Government and the draft Government Resolution as a basis for finalizing the policy. Subsequently, the General Confederation of Labor issued a document incorporating and explaining the opinions of the Party Committee of the Vietnam Fatherland Front, central mass organizations, the Ministry of Justice, and the Ministry of Finance, which was sent to the Ministry of Interior for approval before submitting the Resolution to the Government for promulgation.

Subsequently, the Vietnam General Confederation of Labor sent a document to the Ministry of Interior and the Minister of Interior to provide additional feedback on the draft Government Resolution, suggesting that in addition to the termination policy, a policy on early retirement for full-time trade union officials working under labor contracts who meet the eligibility criteria for early retirement should be added. The benefit level would be 80% of the benefits stipulated in Decree 178/2024/ND-CP.

On September 17, 2025, the Government officially issued Resolution No. 07/2025/NQ-CP, effective from the date of signing until November 1, 2025. The Vietnam General Confederation of Labor will soon issue a guiding document to implement Government Resolution No. 07/2025/NQ-CP.

I believe that Resolution 07 has essentially resolved many of the current issues encountered in the process of reorganizing the organizational structure with the group of full-time trade union officials.

Could you tell us how many people will benefit from Resolution 07? Where will the funding come from? Is implementing the support within just over a month too rushed? Will cases filed after November 1, 2025, be addressed?

According to our preliminary review, 511 cases were initially proposed for benefits under Decree 07, but after further review, only 425 were deemed eligible. These are individuals who signed contracts before January 15, 2019, and received salaries and allowances from trade union funds.

The estimated funding of approximately 400 billion VND to pay 425 people will be sourced from the trade union's allocated funds.

Resolution 07 requires that all individuals covered by the Resolution must have their applications reviewed and processed promptly by the competent authorities before November 1, 2025, meaning that all benefits must be paid out before November 1, 2025. This means that units will have to review applications within less than a month and issue decisions regarding early retirement or termination of employment for those individuals; simultaneously, units must calculate and ensure sufficient financial resources to guarantee payment.

Cases arising after November 1, 2025, will not be processed under Resolution 07. Therefore, time is of the essence, and trade union levels must carefully review files, calculate accurately and completely to ensure timely payment and protect rights.
