(CLO) A jury in California has ordered Starbucks to pay $50 million to Michael Garcia, a delivery driver who suffered severe burns because the lid of a hot beverage was not properly sealed.
Garcia, a Los Angeles resident, went to the Starbucks at the corner of Jefferson Boulevard and Western Avenue to buy three hot teas. According to Garcia's lawyer, a barista at the window inadvertently placed one of the drinks, which was over 82 degrees Celsius, in the container incorrectly.
According to a lawsuit filed in California Superior Court in 2020, one of the hot drinks spilled from its container onto Garcia's thigh, causing severe burns, disfigurement, and serious nerve damage to the genitals.

Garcia's lawyer, Michael Parker, stated that the bartender failed to properly seal the drink, leading to the incident. Garcia's damages include physical pain, emotional trauma, loss of enjoyment of life, disfigurement, and lasting anxiety.
Starbucks said it would appeal the ruling. Jaci Anderson, a Starbucks spokesperson, said: "We are very sorry to Mr. Garcia, but we disagree with the jury's decision that we are responsible for this incident and that the compensation is excessive. We are always committed to adhering to the highest safety standards at our stores, including the handling of hot beverages."
This incident is reminiscent of the famous 1994 lawsuit against McDonald's, where a woman suffered third-degree burns after spilling hot coffee and was awarded nearly $3 million in compensation.
