Amendments to the Electricity Law need to fully address current issues.


The Government Office has just issued Notice No. 500/TB-VPCP on the conclusion of the Government Standing Committee at the meeting on the implementation of important projects of Vietnam Electricity Group and Vietnam Oil and Gas Group to ensure electricity supply and energy security. Accordingly, the Government requires that the amendment of the Electricity Law needs to fully update the current problems;...; supplement the contents on wind power and nuclear power development, and submit it to the National Assembly for approval at the 8th Session according to the one-session process.


Electricity growth must reach 12-15% in the coming years.

The conclusion announcement stated that in the past 9 months of 2024, our country's overall economic growth reached 6.82% (in the third quarter of 2024 alone, it reached 7.4% over the same period), leading to high electricity consumption demand in the last months of the year, expected to increase by 11-13%, higher than the 9% forecast plan.

Despite relatively stable power sources, lessons learned from 2023 were learned, with early and proactive preparation, and improved operational management, ensuring sufficient electricity supply for production, business, and daily life, preventing power shortages. This fulfilled the commitment to prevent power shortages in the North during the dry season of 2024.

The Prime Minister commended the sense of responsibility of the following corporations: Vietnam Electricity Corporation, Vietnam Oil and Gas Corporation, Vietnam Coal and Mineral Industry Corporation, and the Northeast Corporation for their efforts in successfully completing their assigned tasks, contributing to the above results.

The Prime Minister also commended Vietnam Electricity Group for its lightning-fast construction, completing the 500 kV circuit 3 transmission line after more than 7 months, contributing to increasing the power transmission capacity from the Central region to the North and requested Vietnam Electricity Group to continue to well implement tasks and solutions to ensure adequate power supply for the last months of 2024.

By 2025, electricity growth must reach 12-13%.

With an expected economic growth rate of 7% in 2025 and to ensure enough electricity for production, business and people's lives, electricity growth must reach 12-13%. According to the report, the total capacity needed to meet the demand is expected to be about 2,297 MW. Therefore, with the management experience in 2024, the Prime Minister requested that there must be no power shortage in 2025, in which, it is proposed to deploy solutions to ensure compensation for the total capacity shortage.

Specifically, the Prime Minister requested the effective implementation of Government Decree No. 80/2024/ND-CP dated July 3, 2024, which stipulates the mechanism for direct electricity trading between renewable energy power generation units and large electricity consumers.

The Ministry of Industry and Trade is studying ways to promote electricity purchases from Laos, agreeing with Laos on a five-year purchase agreement and adjusting import prices accordingly. In addition, it is also considering the possibility of increasing electricity imports from China to supplement the system if needed.

Electricity prices must be suitable to the socio-economic situation and people's payment level.

For the period 2026-2030, the Ministry of Industry and Trade, the State Capital Management Committee at Enterprises, relevant corporations and groups, based on the electricity growth target of about 12-15% per year, will develop scenarios on power sources, power transmission, power distribution, economical and efficient use of electricity and appropriate electricity prices, with the definite goal of not allowing power shortages under any circumstances for the entire period from now until 2030, both ensuring growth and implementing green transformation, in which electricity prices must be suitable to the socio-economic situation and people's payment level.

The Ministry of Industry and Trade needs to study the shift from coal-fired to gas-fired power generation, diversify power sources, including researching and implementing the construction and development of nuclear power, and focus on developing clean power sources to contribute to combating climate change, green transformation, digital transformation, and the circular economy, such as rooftop solar power, wind power, and waste-to-energy.

Regarding hydropower resources, it is necessary to coordinate with the Ministry of Agriculture and Rural Development to develop a plan for regulating water flow in a harmonious and scientific manner, ensuring irrigation while also maintaining water reserves for power generation and during the dry season in the North.

Regarding electricity generation, it is proposed that electricity prices be calculated appropriately, closely reflecting market conditions and the country's situation, ensuring a balance of interests among all parties, and creating incentives and investment efficiency to encourage investor participation.

The Ministry of Industry and Trade, the Ministry of Finance, the State Capital Management Committee at Enterprises, and the Vietnam Electricity Group, based on their functions, tasks, and authority, will manage electricity prices according to a suitable roadmap, without "jerking"; the electricity industry will promote cost savings, enhance digital transformation applications, increase competitiveness, reduce costs, etc. Electricity prices must be suitable for the economy, with State regulation to stabilize the macro-economy.

Urgently finalize the draft Law on Electricity (amended).

The Ministry of Industry and Trade, as Head of the Working Group reviewing legal problems in the implementation of power projects, continues to preside over and coordinate with the Vietnam Oil and Gas Group and Vietnam Electricity Group in accordance with the direction of the Prime Minister in Decision No. 932/QD-TTg dated September 5, 2024, urgently completing the draft Law on Electricity (amended) to resolve problems such as output commitments (Qc), gas price transfer, in the direction that the law only regulates major problems with many problems, while specific problems with many fluctuations need to be assigned to the Government to regulate such as electricity prices, technical standards, etc.

The law amendment needs to fully update the current problems, with the spirit of opening up space for development but must be manageable, implementing thorough decentralization and delegation of power, eliminating bureaucratic mechanisms, subsidies, "request and grant" mechanisms, cutting administrative procedures, "sub" licenses to reduce compliance costs; adding contents on wind power and nuclear power development, submitting to the National Assembly for approval at the 8th Session according to the one-session process.

The Ministry of Industry and Trade shall preside over and coordinate with the State Capital Management Committee at Enterprises and the People's Committees of the provinces to direct specific plans to quickly deploy, complete and put into operation large-scale power source projects in the North such as: early deployment of Nghi Son LNG - Thanh Hoa (1,500 MW), Quynh Lap LNG - Nghe An (1,500 MW) plant projects; strive to start construction in the second quarter of 2025 and complete energization in 2027 for projects with investors: Quang Ninh LNG (1,500 MW), Thai Binh LNG (1,500 MW); urgently complete the Hoa Binh Hydropower Plant Expansion Project (480 MW), Quang Trach I (EVN - 1403MW), Na Duong II (TKV - 110MW)...

The Ministry of Industry and Trade is reviewing projects included in the Implementation Plan for Power Development Plan VIII but which have not yet been assigned investors, and is directing localities to urgently organize the selection of investors and develop implementation plans to ensure the set progress.

The Ministry of Industry and Trade is urgently reviewing and considering adjustments to the Power Development Plan VIII for the period 2026-2030 to ensure it aligns with socio-economic development and complies with planning regulations, paying particular attention to the implementation of offshore wind power plans, and will report to the Prime Minister.
