'I did not appropriate 45 million dong'

On the afternoon of June 12, the People's Court of Nghe An province continued the appeal trial of the case of teacher Le Thi Dung (52 years old, from Thanh Hoa), former Director of the Center for Vocational Education - Continuing Education of Hung Nguyen district, Nghe An and Nguyen Thi Huong (57 years old, from Ha Tinh), former accountant of the Center for Continuing Education of Hung Nguyen district.

At the trial, defendant Dung said that the accusation of appropriating 45 million VND was incorrect because these expenses were within the unit's internal spending regulations.

“The defendant acted in accordance with the regulations, because in 2012-2017, the content of the regulations on salary, wages, support for party cell secretaries, overtime, going to school, training, testing, summer duty... were brought up for public opinion and discussed throughout the agency.

The court of first instance based on Circular 28/2009 of the Ministry of Education and Training on working regime for general education teachers to charge is incorrect, because this Circular does not apply to continuing education centers. The defendant applied and referred to it to issue internal spending regulations because he is also a teacher," defendant Dung stated.

According to defendant Le Thi Dung, she is the director of the center but in reality she is still a teacher, entitled to overtime pay. At the time the defendant was sent to school, the hours during the school period must also be counted as actual hours, so paying overtime is not wrong, converting to calculate working days.

If the defendant is wrong, the Hung Nguyen District Finance and Planning Department, the person who approved the revenue and expenditure plan at the beginning of the year, and the person who supervised the revenue and expenditure must be jointly responsible.

"I do not accept the use of the word appropriation by the panel of judges. For many years of issuing regulations, the Nghe An Department of Education and Training has always concluded correctly, so why say it is appropriation? The amount of 45 million VND is not a loss, but it is the effort of the director in particular and all teachers in general," defendant Dung said.

Before the testimony of defendant Le Thi Dung, the panel of judges determined that the defendant had to pay tuition and business expenses from the State budget for going to school, so converting school hours into overtime pay was not in accordance with regulations.

The representative of the People's Court said that if the Center wants to include it in its internal regulations, it must have the consent of the Department of Education and Training. In fact, the Department has not yet commented on this aspect.

After listening to the debate of the People's Court, the representative of the Department of Education and Training of Nghe An province said that they would accept the opinions and ask for opinions from superiors to respond later.

As reported by VTC News , on April 7, 10, 11, 17 and 24, the People's Court of Hung Nguyen District (Nghe An) held a first-instance trial of Ms. Le Thi Dung, former Director of the Center for Continuing Education and Vocational Training of Hung Nguyen District (Nghe An) for the crime of "Abusing position and power in performing official duties".

According to the indictment, after being appointed as director, Ms. Le Thi Dung held meetings and issued internal spending regulations from 2012 to 2017. The issuance of the above internal spending regulations must be sent to the superior management agency, the Department of Education and Training, but she did not send them.

From this violation, in 2012, 2014, 2015, 2016, as the director and account holder of the center, Ms. Le Thi Dung declared some payment contents twice for a financial transaction.

Ms. Le Thi Dung caused damage to the state budget of more than 44.7 million VND.

After many days of trial, the People's Court sentenced the defendant Le Thi Dung to 5 years in prison. In addition, the People's Court also requested to collect more than 44.7 million VND from the defendant Dung to return to the Hung Nguyen District Continuing Education and Vocational Training Center.

After the court announced the verdict, defendant Dung filed an appeal against the entire first instance judgment.
