Ho Chi Minh City announces the 4th draft of regulations on extra teaching, allowing teaching after 8:00 p.m.

The Ho Chi Minh City Department of Education and Training removed the regulation prohibiting extra teaching after 8:00 p.m. in the new draft, but still requires principals to be responsible for managing extra teaching teachers.

The Ho Chi Minh City Department of Education and Training has just released the fourth draft of regulations on extracurricular tutoring in the city. This draft still stipulates that school principals manage teachers who provide extracurricular tutoring outside of school, but removes the provision prohibiting tutoring after 8 PM.

According to the draft, the principal is responsible for organizing extracurricular tutoring activities within the school in accordance with the regulations of the Ministry of Education and Training ; managing the school's teachers when they participate in extracurricular tutoring outside the school; coordinating the monitoring and inspection of extracurricular tutoring activities of teachers under their management; being accountable to the superior authority for the organization and quality of extracurricular tutoring within the school; and simultaneously handling or recommending to the competent authority to handle related violations.

For tutoring centers, the Ho Chi Minh City Department of Education and Training requires that before organizing tutoring sessions, they must report to the local education management agencies the list of tutoring classes; the timetable for tutoring classes; the list of tutors; the tuition fees for tutoring, etc.

Tutoring centers must fully update their information on the Department of Education and Training's tutoring management software system; ensure adequate facilities for tutoring, and comply with current laws regarding working hours, overtime hours, and regulations on security, order, safety, environmental hygiene, and fire prevention.

Regarding state management agencies, the draft regulations stipulate that the Ho Chi Minh City Department of Education and Training is responsible for advising the City People's Committee on allocating budget for extracurricular tutoring activities in schools; managing all extracurricular tutoring activities of organizations and individuals under its purview; coordinating with relevant units to conduct inspections, checks, and handle violations within its authority; and simultaneously building a common database system to manage extracurricular tutoring activities throughout the city.

The draft also assigns the People's Committees at the commune and ward levels the responsibility of managing extracurricular tutoring activities of schools, organizations, and individuals in their areas; inspecting compliance with relevant regulations; and handling or recommending to competent authorities the handling of violations.

At the same time, the People's Committee of the commune or ward must coordinate with functional units to organize periodic inspections of tutoring activities and take timely corrective measures when violations are detected.

Remove the clause prohibiting tutoring after 8 PM.

Notably, the fourth draft of the regulations on tutoring and supplementary education by the Ho Chi Minh City Department of Education and Training no longer includes the clause prohibiting tutoring after 8 PM, unlike the previous draft. Previously, this clause had sparked debate across various sectors and fields. While many supported banning tutoring after 8 PM to protect students' health, many others opposed it, arguing that it infringed upon students' right to freedom of learning.

Ho Chi Minh City currently has approximately 3,000 teachers registered to provide extra tutoring at 1,300 centers, all of which are publicly listed on the Ho Chi Minh City Department of Education and Training's extra tutoring management software at https://dtht.hcm.edu.vn .
