
The Department of Agriculture and Environment of Ho Chi Minh City has just sent Document No. 6260/TTr-SNNMT-QLD to the People's Committee of Ho Chi Minh City on approving the list of land plots planned to implement pilot projects in the city according to Resolution 171/2024/QH15 dated November 30, 2024 of the National Assembly.
Resolution 171/2024/QH15 approving the pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights, effective from April 1, 2025.
Specifically, the Department of Agriculture and Environment has submitted a list of 74 land plots expected to implement the pilot project according to Resolution 171/2024/QH15, with a total area of about 1,079.62 hectares, of which the residential land area is 531.27 hectares, including existing residential land of about 8.21 hectares, and land expected to change its purpose to residential land of about 523.07 hectares; the rice-growing land area expected to change its purpose is about 42.3 hectares, without changing the purpose of protective forest land, special-use forest land, and production forest land.

For the remaining land that organizations have registered to implement the project, the Department of Agriculture and Environment will preside over the organization of the next review and assessment (phase 2) in October 2025.
According to the submission, the land plots included in the list (according to Clause 5, Article 4 of Decree No. 75/2025/ND-CP dated April 1, 2025 of the Government) are based on conditions and criteria, such as: The scope of the land plot and land plot for project implementation is consistent with the district-level land use planning or construction planning, urban planning; the scope of the land plot and land plot for project implementation is consistent with the approved local housing development program and plan; implemented in urban areas or areas planned for urban development.
In addition, the total area of residential land plots and land plots in pilot projects (including existing residential land and land planned to change its land use purpose to residential land) shall not exceed 30% of the additional residential land area in the planning period (compared to the current status of residential land use) according to the approved land allocation and zoning plan in the provincial planning for the period 2021 - 2030; not included in the projects specified in Clause 4, Article 67 of the Land Law.

For the case specified in Point a, Clause 1, Article 1 of Resolution No. 171/2024/QH15 (project of real estate business organization receiving land use rights), the land area implementing the pilot project must not be on the list of works and projects requiring land recovery approved by the Provincial People's Council according to the provisions of Clause 5, Article 72 of the Land Law.
In case after synthesizing according to the above provisions, the total residential land area registered to implement pilot projects exceeds 30% as prescribed in Point b, Clause 1, Article 4 of Resolution No. 171/2024/QH15, the selection of land plots to implement pilot projects shall be in order of priority in Clause 6, Article 4 of Decree No. 75/2025/ND-CP.
According to the report, in Ba Ria - Vung Tau province there are 59 land plots, old Ho Chi Minh City has 15 land plots. The list of 74 land plots is as follows:
