This afternoon, December 4, the National Assembly Delegations of Group 7 (National Assembly Delegations of Nghe An and Lam Dong provinces) discussed the draft Resolution on mechanisms and policies for national energy development in the 2026-2030 period and the draft Law on Specialized Courts at the International Finance Center.

Clarifying transmission costs, combating price monopoly

Discussing the draft Resolution on the mechanism and policy for national energy development in the 2026-2030 period, National Assembly Deputy Tran Duc Thuan (Nghe An) affirmed the urgency of the Resolution, emphasizing that energy is the "blood vessel" of the economy and is directly related to national defense and security, so it is necessary to consider carefully and only regulate new contents, which are stuck or have not been legalized, to avoid overlap between laws.

Supporting socialization in energy development, especially rooftop solar power and mobilizing private resources to participate in transmission, National Assembly Deputy Tran Duc Thuan suggested that the State must strictly control to ensure energy security and avoid massive development causing overload. The delegate suggested to soon issue a framework mechanism on socialized electricity transmission to avoid legal risks.

Regarding electricity prices and the direct power purchase mechanism (DPPA), delegates requested clarification of transmission costs, anti-monopoly pricing and control of abuse of dominant position, because the recent unusual fluctuations in electricity prices have caused outrage. Delegate Tran Duc Thuan also emphasized: Electricity planning must be linked to national defense factors, the location of the plant must be safe and reasonable; any adjustment to the VIII Electricity Plan must consult the Ministry of National Defense.

Delegates warned of the risk of industrial waste from expired solar panels and suggested adding regulations on environmental responsibility (EPR), ensuring environmental control throughout the project life cycle. At the same time, there should be a mechanism to exempt officials from responsibility for implementing the pilot in accordance with regulations to avoid the mentality of "fear of mistakes".

Delegates affirmed: The Resolution must create a foundation for energy development in the 2026-2030 period, ensuring sustainability, national security and defense, effectively mobilizing social resources while still maintaining the State's regulatory role.

Delegate Nguyen Tao (Lam Dong) pointed out many shortcomings in practice, especially in the transmission stage due to the incomplete socialization mechanism, leading to conflicts between investors and management agencies, such as the case of the 500 kV Trung Nam line. On that basis, the delegate suggested that the Resolution must cover nuclear power - a strategic, stable energy source associated with high-tech industries - and clearly identify the affected subjects, including people in the planning area and the energy project corridor.

Regarding electricity planning and market, delegates said that the State must play a proactive role; it is necessary to review the Power Plan VIII to ensure synchronization of sources. Currently, EVN only holds less than 15% of production capacity, while transmission and distribution are still monopolized, causing losses and slow infrastructure upgrades.

Delegates proposed that the National Assembly resolve three major orientations: socializing electricity production, socializing transmission, and socializing distribution, in order to attract resources and avoid the recurrence of wind and solar power capacity cuts. Regarding electricity distribution, there is no need to maintain the monopoly of electricity branches; electricity prices must be calculated correctly and fully, avoiding cross-subsidization.

Regarding nuclear power, delegates proposed piloting a model of State planning and production; transmission and distribution can be partially socialized.

Unification of jurisdiction of specialized courts

Regarding the draft Law on Specialized Courts at the International Financial Center, delegate Tran Nhat Minh (Nghe An) focused on analyzing a number of contents related to legislative techniques, scope of regulation and the unity of the legal system.

Regarding Article 4 of the draft Law regarding the interpretation of terms, the delegate said that it is unnecessary to explain some terms "Judge" and "Court Secretary", because these contents have been fully regulated in the Law on Organization of People's Courts as well as in the draft itself. The delegate suggested adjusting in the direction of explaining the group "Persons conducting proceedings", including Chief Justice, Judge and Court Secretary, similar to the approach in current procedural laws.

The delegate also proposed to amend Clause 5 of Article 4. The phrase “parties” should be replaced by “Participants in the proceedings” to clearly define the scope, and it is necessary to add “Protectors of the legitimate rights and interests of the litigants”, according to the law. According to the delegate, not defining this group of subjects would be a shortcoming because they are the force directly participating in the litigation process.

Regarding Article 9 regarding the standards of Judges, delegates expressed concerns about the regulations on age. Clause 3, point a stipulates the age of “not exceeding 75 years old” for civil servants and university lecturers if they meet the conditions for appointment as Judges. Delegates asked the drafting agency to clarify whether this regulation is consistent with the retirement age under the Labor Code or not. At the same time, they questioned whether if civil servants and university lecturers are entitled to the age mechanism up to 75, will the team of People's Court Judges - those who are performing adjudication functions according to current law, be entitled to the same policy or not?

Referring to Article 11 on Court Secretaries, the delegate said that the provision “The Secretaries perform duties as assigned by the Chief Justice” is not close to reality. In the process of resolving cases, the Secretary works directly with the Judge, while the Chief Justice mainly performs management functions. The delegate suggested adding the Judge’s assignment authority to ensure compliance with the reality of Court work.

Regarding Article 12, Clause 4 relating to the settlement of jurisdictional disputes, the delegate proposed to clarify the regulatory mechanism. If a jurisdictional dispute occurs within a specialized court, there is almost no problem because there is a clear process. However, in the event of a jurisdictional dispute between a specialized court and a People's Court, the decision-making power cannot be delegated to the Chief Justice of the specialized court. In principle, this power must belong to the Chief Justice of the Supreme People's Court. The delegate suggested that the drafting agency review and revise to ensure the rationality and consistency of the judicial system.

Regarding Article 17 on the statute of limitations for filing a lawsuit, the delegate noted: the draft has not yet added cases where the statute of limitations is exceeded due to force majeure or objective obstacles, to avoid legal gaps in practice.

According to delegate Tran Nhat Minh, completing the draft Law on Specialized Courts requires special attention to legislative techniques, ensuring compatibility with the current legal system and creating a solid legal basis for the operation of Specialized Courts in the International Financial Center.
