Currently, the Ho Chi Minh City Tourism Association (HCMC Tourism Association) has announced that it has received petition No. 57/CV-HHDL dated July 30th from the Nha Trang - Khanh Hoa Tourism Association regarding fraud and misappropriation of assets by VIET SKY Service and Trading Company Limited (headquartered in HCMC, hereinafter referred to as Viet Sky Company).
Petition to clarify the fraudulent activities of VIET SKY
Through this petition, the Ho Chi Minh City Tourism Association recognizes the urgent need for investigation and action from competent authorities to protect the rights and interests of member businesses of the Nha Trang - Khanh Hoa Tourism Association, as well as to ensure a healthy and clean tourism business environment.
The Ho Chi Minh City Tourism Association has sent a document to the Ho Chi Minh City Police and the Ho Chi Minh City Department of Tourism requesting an investigation into Viet Sky Company and strict measures to both protect the rights of the affected businesses and build a healthy business environment.
Previously, the Nguoi Lao Dong newspaper reported that many hotels in Nha Trang City accused Ms. Nguyen Le Uyen P. - Director of Viet Sky Company - and Mr. Le Thanh T. - an employee of this company - of contacting the hotels to book accommodation services.
As the Viet Sky Company's group was preparing to leave, the hotel staff asked Mr. T. to pay the remaining amount.
Mr. Le Thanh T. only sent a screenshot via Zalo showing the bank transfer confirmation and the payment authorization form.
The transaction image was sent via text message to the hotel staff, but in reality, no money was credited to the account at the time the Viet Sky Company's group left the December Hotel (Nha Trang).
Therefore, the hotels agreed to let the group leave. However, the money did not actually go into the hotel's account. Mr. T. denied sending fake transaction images, refusing to pay, and blocking communication.
More specifically, the International Consulting Law Firm (located in Ho Chi Minh City, abbreviated as TVQT Law Firm) also reported fraudulent appropriation of property. Specifically, in July 2023, this company booked a tour to Bali (Indonesia) with Viet Sky Company for nearly 500 million VND, paying nearly 350 million VND in advance.
Just before the departure date, TVQT Law Firm unexpectedly received news that Viet Sky Company had mistakenly booked the wrong tickets, but when requested to provide the ticket code, Viet Sky Company refused to cooperate. The Ho Chi Minh City Department of Tourism Inspectorate also confirmed that Viet Sky Company did not have a license to operate international travel services.
The International TV Law Firm proposed initiating criminal proceedings, imposing a temporary travel ban on the individual, and suspending the operations of Viet Sky Company.
Meanwhile, the leaders of the Nha Trang - Khanh Hoa Tourism Association claim that Viet Sky Company engaged in the practice of releasing payment information at the last minute to pressure restaurants and hotels into allowing customers to leave.
Viet Sky Company engaged in systematic and repeated fraudulent activities targeting numerous businesses and individuals. They exploited trust to embezzle large sums of money from these businesses.
Payments were only made after numerous letters and petitions were submitted to relevant authorities to protect the legitimate rights and interests of the members.
"We hope that the authorities will investigate, handle, and take measures to prevent these individuals from causing further incidents that affect the tourism environment and social order," the leader of the Nha Trang - Khanh Hoa Tourism Association suggested.
VIET SKY cited "accident" as the reason.
Speaking to a reporter from Nguoi Lao Dong newspaper, Mr. Le Thanh T. - representative of Viet Sky Company, stated that it was a delayed payment, not an act of fraud.
According to Mr. T., by August 1st, Viet Sky Company had fully paid for the rooms at both hotels in Nha Trang.
The reason for the delay is that the tour operators have not yet paid Viet Sky Company. Viet Sky has informed the hotels about this issue. Both parties have agreed that it was a work-related accident.
Regarding the accusation of forged payment authorizations and transactions posted on Zalo, Mr. T explained that it was an "accident." Specifically, at the time of payment, Viet Sky Company had issued a money transfer order, but the company's leadership had not yet approved it.
The image provided by Viet Sky was mistakenly presented by the hotel staff as a payment authorization form, which is incorrect because the transaction was not successful.
"If the account doesn't have enough money, the money transfer order can't be created. In fact, when the management approved the transfer, an 'accident' occurred. The company's account went into the negative due to automatic tax deductions. I informed the hotel about this issue and requested a delayed payment," Mr. T explained.
Regarding the Four Seasons restaurant being accused of placing a food order on July 13th but Viet Sky Company still not paying the remaining balance by August 1st, Mr. T. stated that this was because a contract termination agreement with the restaurant had not yet been finalized.
"The restaurant charged a fee for arranging a meal on the beach, but it was raining that day. Since the contract termination hadn't been finalized, how can that be considered defaulting on payment?" Mr. T said.
Viet Sky Company is accused of accepting nearly 350 million VND in deposits for a trip to Bali (Indonesia) from TVQT Law Firm despite not having an international travel license.
Regarding TVQT Law Firm specifically, Mr. T. admitted that he had been fined by the Ho Chi Minh City authorities for not having an international travel agency license. The company had its operating license revoked for two months.
Regarding the nearly 350 million VND deposit that TVQT Law Firm paid, why did Viet Sky Company not return it? Mr. T. stated that the Ho Chi Minh City Police had investigated, and subsequently, Viet Sky Company agreed to compensate 10% of the contract value.
Mr. T. also stated that Viet Sky Company had transferred money to TVQT Law Firm multiple times and requested confirmation of receipt from the latter before transferring the remaining amount.
