
Speaking at the seminar, Dr. Pham Viet Thuan, Institute of Natural Resources and Environment Economics of Ho Chi Minh City informed that according to Resolution No. 316/NQ-CP issued by the Government, the ministries, branches and localities have been assigned to reorganize the agricultural extension system and the Land Registration Office (LRO) according to the two-level local government model. The goal of this resolution is to streamline the apparatus, unify data and improve efficiency in serving people and businesses. However, the implementation shows that the transfer of functions to the commune level at the present time still has many problems due to insufficient human resources, unsynchronized information technology infrastructure; the national land database is still in the process of completion. From surveys in localities, the institute recommends maintaining the current branch model of the LRO, and adjusting the time of transferring functions to the commune until the conditions for human resources, data and technology are met.

At the seminar, Associate Professor Dr. Nguyen Dinh Tuan, former Principal of the University of Natural Resources and Environment of Ho Chi Minh City, said that transferring the branch of the Land Registration Office to the commune level needs to meet four conditions. First, completing the digital land database of the whole province and city and ensuring transmission lines and equipment at the commune level. Second, the legal framework must be completed and specific regulations on authority, decentralization and organizational transformation must be issued. Third, training, rearranging staff, guiding the conversion of civil servants and training commune land administration. Fourth, there must be a roadmap for pilot implementation, experience drawing, and gradual expansion; regular monitoring, avoiding interruption of public services.
“If we implement the right roadmap, ensuring infrastructure, legality, and human resources, this will be an important step forward to help the land registration system operate in a unified, transparent, and effective manner, contributing to promoting sustainable socio-economic development,” Associate Professor Dr. Nguyen Dinh Tuan shared.

According to lawyer Hoang Thi Thu, Director of HTVN Law Company Limited, in recent years, land disputes and lawsuits have occurred frequently, even developing into dangerous and complicated criminal cases. Therefore, every step and every change regarding land needs to be carefully considered, ensuring the legislative aspect as well as the consensus and support of the people.
"The issue of whether to abandon or maintain the model of the Registration Office Branch is extremely urgent but is a difficult problem. If not handled thoroughly, it will easily lead to disruptions in the administrative apparatus, which is not yet completely stable after the merger. Therefore, the temporary solution is to keep the Registration Office and branch model intact, while applying measures to improve operational efficiency. Only when both the transferring agency and the receiving agency are ready, meeting the requirements in terms of personnel, budget, equipment as well as having a clear legal mechanism can the transfer be quick and synchronous," said lawyer Hoang Thi Thu.
