Prime Minister's directive on the implementation of the 2025 amnesty program (phase 2)

Deputy Prime Minister Nguyen Hoa Binh has just signed Official Dispatch No. 108/CD-TTg dated July 16, 2025, on the implementation of the 2025 amnesty program (phase 2).

Implement the amnesty program in 2025 seriously and effectively.

The official dispatch sent to the ministers of the Ministries of Public Security, National Defense, Culture - Sports and Tourism; the Supreme People's Court; and the chairmen of the People's Committees of provinces and centrally-administered cities stated: On July 4, 2025, the Clemency Advisory Council issued Guidance No. 94/HD-HĐTVĐX on the implementation of Decision No. 1244/2025/QĐ-CTN dated July 3, 2025, of the President of Vietnam on clemency in 2025 (second phase).

To ensure the serious and effective implementation of the 2025 amnesty program (phase 2), to effectively carry out the humane and lenient policies of the Party and State towards offenders, and to contribute to the effective implementation of resolutions, directives, programs, and plans of the Central Committee, the National Assembly , and the Government on crime prevention and control, the Prime Minister requests:

The Ministry of Public Security effectively performs its function of leading and advising the Government and serving as the Standing Committee of the Clemency Advisory Council; it is directly responsible for directing the review of clemency requests for prisoners serving sentences in prisons and detention centers under the Ministry of Public Security's management; it urges, guides, and inspects ministries, sectors, and localities in implementing the clemency program, promptly resolving difficulties and obstacles that arise, and reporting to the Clemency Advisory Council for consideration in cases exceeding its authority.

The Ministry of National Defence is directly responsible for closely supervising the review of pardon requests for prisoners serving sentences in prisons and detention centers under its management.

The Prime Minister requested that the Supreme People's Court directly instruct and guide the People's Courts and Military Courts at all levels to preside over the consideration of pardon requests for individuals whose prison sentences have been temporarily suspended.

The Ministry of Culture, Sports and Tourism directs news agencies and media outlets to fully report on the content of documents regarding the 2025 amnesty (second phase) so that all citizens and prisoners understand the conditions, procedures, and processes for considering amnesty... enabling them to protect their legitimate rights and interests, independently verify and monitor the activities of relevant agencies, and avoid confusion and errors; at the same time, contributing to raising awareness and responsibility among all levels, sectors, social organizations, and the general public to eliminate stigma towards those granted amnesty and to care for and help them reintegrate into the community.

The ministries, departments, and agencies mentioned in the Clemency Advisory Council's guidelines have specific plans to implement their assigned tasks; they organize the dissemination and thorough understanding of the clemency process, ensuring it is carried out uniformly, safely, openly, transparently, following strict procedures, targeting the right individuals, and meeting the conditions stipulated by law; they ensure the legitimate rights and interests of prisoners and those whose sentences are temporarily suspended, and absolutely prevent any negative incidents or errors.

Providing assistance, vocational training, and job opportunities for pardoned individuals returning to reintegrate into the community.

The Prime Minister requested the chairpersons of the People's Committees of provinces and centrally-administered cities to direct relevant departments and commune-level People's Committees to coordinate with the Fatherland Front and other relevant agencies and organizations to strictly implement Decision No. 1244/2025/QD-CTN dated July 3, 2025, on the 2025 amnesty (second phase) of the President and Guidance No. 94/HD-HDTVDX dated July 4, 2025, of the Advisory Council on Amnesty.

Specifically:

- Direct the Department of Culture, Sports and Tourism to closely coordinate with the Propaganda and Mass Mobilization Departments of the provincial and city Party Committees, and local media agencies to widely publicize the amnesty program through mass media.

- Direct relevant departments and agencies, and the People's Committees at the commune level, within their respective functions and duties, to provide complete information, documents, certificates, confirmations, and other necessary materials related to the person proposed for amnesty.

- Directing commune-level authorities to coordinate with the Fatherland Front, agencies, economic organizations, mass organizations, and social organizations in the locality to actively and effectively implement Government Decree No. 49/2020/ND-CP dated April 17, 2020, detailing the implementation of the Law on Execution of Criminal Sentences on community reintegration. The Prime Minister requested continued monitoring, management, education, assistance, vocational training, and job creation for pardoned individuals returning to the community to overcome feelings of shame, engage in honest work, and reduce recidivism and violations of the law. For pardoned individuals with particularly difficult circumstances, mobilizing relevant sectors, mass organizations, and socio-economic organizations to provide assistance in obtaining loans for business, stabilizing their lives, and reintegrating into the community.

- Direct provincial police directors to coordinate with local departments, agencies, mass organizations, and social organizations to effectively manage, educate, and assist those granted amnesty; closely monitor the situation and developments of those granted amnesty residing in the locality, preventing them from affecting national security and social order and safety; and promptly and strictly handle those who re-offend or violate the law.

The Prime Minister assigned the Ministry of Public Security (the Standing Agency of the Clemency Advisory Council) the responsibility of monitoring, compiling, and reporting the results of implementation to the Prime Minister and the Clemency Advisory Council.
