Insufficient legal basis
On October 10th, the Da Nang Department of Education and Training issued Official Document 3018 to its affiliated public service units, announcing the suspension of professional title promotion reviews for public kindergarten and primary school teachers. Accordingly, the promotion process for public kindergarten and primary school teachers will be temporarily suspended.
Accordingly, the Da Nang Department of Education and Training has developed a plan to organize the promotion of professional titles from rank III to rank II for preschool and primary school teachers in public educational institutions under its management, and has reported and requested the competent authority to appraise and approve the quotas for implementation.
In conducting the assessment of promotion criteria, the Department of Internal Affairs requests the Department of Education and Training to consider the timing of conducting the promotion assessment to professional titles of rank II or higher when all legal grounds are ensured.
Specifically, according to Clause 2, Article 32 of Government Decree No. 115/2020/ND-CP dated September 25, 2020, on the recruitment, use, and management of civil servants (amended and supplemented by Clause 16, Article 1 of Decree No. 85/2023/ND-CP), for the consideration of promotion to professional titles of Grade II and Grade I, in addition to the general conditions as prescribed, the Ministry managing the specialized professional title must issue specific regulations on the standards and conditions for promotion consideration.
To date, the Ministry of Education and Training has not issued a Circular stipulating the conditions and standards for promotion of professional titles for public kindergarten and primary school teachers. The Da Nang Department of Education and Training has requested the Ministry of Education and Training to promptly issue the Circular so that the locality has a legal basis to implement the promotion of kindergarten and primary school teachers from rank III to rank II.
Following the Ministry's circular, the Department of Education and Training will immediately implement the promotion review process for teachers under its management; units should send representatives to the Personnel and Organization Department (Da Nang Department of Education and Training) to retrieve the files of teachers who have registered for the promotion review, either for safekeeping or for the teachers to keep, in order to continue the registration process when instructed by the Department of Education and Training.
Previously, the People's Committees of the districts and communes of Da Nang City established councils to review the promotion of preschool, primary, and secondary school teachers from rank III to rank II in public education and training institutions under their jurisdiction. For example, Hai Chau district had 427 civil servants who passed the promotion review held in July 2024, including: 296 preschool teachers; 73 primary school teachers; and 58 secondary school teachers. Thanh Khe district had 301 teachers promoted from rank III to rank II.
Hoa Lu Primary School (Thanh Khe District) has 12 out of 13 teachers recognized for promotion from rank III to rank II and will begin receiving their new salaries from October 2024. Ms. Huynh Thi Thanh Tinh – the school principal – said: “The promotion results have created more motivation for teachers to strive for improvement, from those who were promoted from rank III to rank II to young teachers who did not have enough seniority to participate in the promotion review.”

Teacher's thoughts and feelings
At the time the People's Committee of Lien Chieu District (Da Nang) organized the review for promotion of kindergarten, primary, and secondary school teachers from rank III to rank II in affiliated public education and training units, Mr. Le Vo Minh Hop – a teacher at Nguyen Binh Khiem Secondary School – still had 3 months remaining on his service time requirement.
Despite having nearly 10 years of teaching experience, because the one-year probationary period is not counted, Mr. Hop did not meet the requirements to participate in the promotion examination as of August 2024. Therefore, upon hearing the news that the Da Nang Department of Education and Training had temporarily suspended the examination, Mr. Hop said his only concern was when the promotion examination would resume.
Mr. Le Minh Hieu, a teacher at Le Dinh Chinh Primary School (Hai Chau District, Da Nang City), has registered to participate in the school-level excellent teacher competition for the 2024-2025 school year and is striving to meet the criteria to be considered for the title of outstanding teacher at the school level.
“In July 2024, when the Hai Chau District People's Committee announced the teacher promotion exam from Grade III to Grade II, I hadn't had enough years of service. Meanwhile, my achievement score had already reached 20 points. If the suspension of the promotion process is prolonged, it will be very unfair to teachers who are expected to be eligible to participate in 2025,” Mr. Hieu expressed his concerns.
While the units and schools under the district-level Departments of Education and Training in Da Nang have already undergone a promotion review and received new salaries, the units and schools under the Department of Education and Training have yet to see any changes. Voter Vo Thi Huong – Group 22, Nai Hien Dong Ward (Son Tra District, Da Nang City) also submitted a petition to the Da Nang City People's Council, requesting that the Department of Education and Training coordinate with the Department of Interior Affairs to consider promotion reviews for high school teachers.
In Official Letter No. 7415 dated December 15, 2023, regarding the implementation of regulations on promotion of civil servant professional titles, the Ministry of Interior requested that ministries managing specialized civil servant professional titles promptly issue regulations on standards and conditions for promotion consideration as stipulated in Clause 16, Article 1 of Decree No. 85/2023/ND-CP, ensuring compliance with the deadline stipulated in Clause 5, Article 2 of Decree No. 85/2023/ND-CP, as a basis for ministries, sectors, and localities to promptly organize civil servant promotion consideration.
