I was a contract high school teacher from September 2012 to July 2017, intermittently, and did not receive social insurance benefits (the contract period was 4 years and 9 months). In August 2020, I passed the civil servant exam and did not have to undergo a probationary period.
The local authorities have recently issued a document reviewing teacher promotion. I would like to ask how the time spent in my current rank is calculated for promotion consideration? The standards and conditions for promotion to the professional title of High School Teacher Grade II (code V.07.05.14) are implemented according to the regulations in Article 9 of Circular No. 13/2024/TT-BGDĐT. Specifically, the standards and conditions regarding the time spent in the current rank, as stipulated in Clause 5 of Article 9, are as follows: Meeting the requirements for the time spent in the professional title of High School Teacher Grade III (including time spent in equivalent ranks) as stipulated in Clause 4 of Article 4 of Circular No. 08/2023/TT-BGDĐT.
In cases where teachers, prior to recruitment or appointment, have had a period of employment in accordance with the law and have paid mandatory social insurance contributions, the provisions of the Government at point d, clause 1, Article 32 of Decree No. 115/2020/ND-CP, as amended and supplemented by clause 16, Article 1 of Decree No. 85/2023/ND-CP, shall apply.
Therefore, the period of your employment in accordance with the law, with mandatory social insurance contributions as stipulated in point d, clause 1, Article 32 of Decree No. 115/2020/ND-CP, as amended and supplemented by clause 16, Article 1 of Decree No. 85/2023/ND-CP, is considered equivalent to the time holding the professional title of High School Teacher Grade III.
In addition to the criteria regarding the length of service, there are other criteria (such as the results of performance evaluations and rankings; educational and training qualifications; and professional competence and expertise standards).
Please provide the required evidence regarding the standards and conditions stipulated in Article 9 of Circular No. 13/2024/TT-BGDĐT to the competent authority at the local level for considering promotion to the professional title of High School Teacher Grade II, in order to determine your level of eligibility for promotion.
