Removing legal "bottlenecks" to clear the flow for the private economy

On August 25, the Vietnam Young Entrepreneurs Association in collaboration with Ho Chi Minh City University of Law and Ho Chi Minh City Green Business Association organized a scientific workshop with the theme: "Creative institutions - Unblocking the flow of development". The event is an important legal session within the framework of the Vietnam Private Sector Economic Forum 2025 (VPSF 2025).

The workshop emphasized the driving role of the private economy , as this sector contributes about 50% of GDP, over 30% of state budget revenue and employs up to 82% of the workforce. However, delegates said that many legal "bottlenecks" are hindering the strong development of this sector. One of the major issues discussed was the risk from criminal law regulations.

According to Dr. Nguyen Thi Anh Hong, Head of the Criminal Law Department, Ho Chi Minh City University of Law, legal thinking needs to change in the direction of reducing the criminalization of economic relations. Dr. Nguyen Thi Anh Hong said: "Criminal law must be a "shield" for legitimate investment and business activities, instead of becoming a tool to create pressure or risk for businesses". She also pointed out the lack of specific policies to protect the private economy, the general application of crimes is causing difficulties in protecting business rights. Therefore, legal policies need to clearly distinguish between civil, administrative and criminal responsibilities.

In addition, in the field of sustainable development, the trend of green buildings is determined to be inevitable but the implementation still has many obstacles. Ms. Luu Thi Thanh Mau, General Director of Phuc Khang Corporation, Vice President of the Vietnam Young Entrepreneurs Association and Vice President of the Ho Chi Minh City Real Estate Association, commented that the implementation of Resolution 68-NQ/TW on encouraging green credit is still limited. The reason is due to lack of synchronization, there is no separate set of green building standards for Vietnam and the implementation is mainly voluntary.

To solve this problem, Master Luu Thi Thanh Mau suggested: "The State needs to specify the green transformation policy, issue a set of national green building standards similar to Singapore's, and apply mandatory regulations to both public and private projects, along with sanctions to ensure enforcement."

All recommendations from the workshop will be compiled and sent to the National Assembly and the Government within the framework of VPSF 2025, to contribute to creating a transparent legal environment that protects and accompanies private enterprises.
