Hanoi: Strictly handle groups and individuals using public assets in violation of regulations

The Hanoi People's Committee recently issued Official Document No. 4955/UBND-KT, dated September 5, 2025, regarding the focused implementation of the arrangement, organization, handling, and renovation of public offices and assets when reorganizing commune-level administrative units.

Avoid overlooking or losing assets.

To ensure that the review, arrangement, and handling of public offices and assets during the reorganization of administrative units are effective, transparent, sustainable, and free from loss and waste, the City People's Committee requests that directors and heads of departments, agencies, and units under the city, as well as chairmen of the People's Committees of wards and communes, continue to thoroughly and promptly implement the directives of the Central Government and the city regarding the decentralization and delineation of state management authority in the field of public asset management and use, and public asset management during the streamlining of the apparatus and the reorganization of administrative units.

Review and inventory the assets of district-level and commune-level administrative units (before reorganization) that have been transferred to agencies, organizations, and units under their management during the reorganization of commune-level administrative units. This review and inventory should be conducted in conjunction with a comparison of the results of the general inventory of public assets as prescribed, to avoid omissions or losses of assets during the reorganization of administrative units.

At the same time, direct agencies, organizations, and units assigned to manage public assets under their management to promptly carry out registration procedures and complete ownership and usage rights of assets in accordance with legal regulations; implement accounting, management, and use of assets in accordance with legal regulations; review, issue new, amend, supplement, and replace regulations on the management and use of public assets at agencies, organizations, and units to suit their functions, tasks, and new organizational structure.

The People's Committees of communes and wards shall proactively arrange and consolidate land and buildings within their respective areas to ensure adequate office space for agencies, organizations, and units under their management during the administrative reorganization process; they shall develop plans and strategies for managing, arranging, and immediately disposing of unused or underutilized office buildings (and other land and buildings) in accordance with the schedule and directives of the City People's Committee.

In cases where, after the reallocation and redistribution of assets among agencies, organizations, and units, there is still a shortage of assets or existing assets do not meet the requirements for performing tasks, supplementary procurement shall be carried out according to the standards and norms issued by the competent authority. Repair, renovation, and upgrading of old facilities shall be undertaken to ensure adequate infrastructure for task performance. Priority should be given to ensuring the provision of offices, machinery, equipment, internet access, and other assets for public administrative service centers or public administrative service points in the current period to meet the requirements for providing public services and handling administrative procedures for businesses and citizens without interruption. At the same time, attention should be paid to the physical infrastructure and conditions for preserving archived records and documents, preventing damage from pests, mold, and mildew that could affect the quality of records and documents.

Resolving the issue of surplus houses and land after the restructuring.

To continue addressing the issue of surplus land and buildings after administrative unit reorganization in a timely and decisive manner, the People's Committees of communes and wards are responsible for directing agencies, units, and organizations under their management to promptly develop plans for handling and exploiting surplus buildings based on the prescribed methods of asset disposal and exploitation. These plans should be submitted to the competent authorities for consideration and decision on the handling and exploitation of each specific land and building; based on these plans, the handling should be carried out within the prescribed timeframe and in accordance with the law.

The City People's Committee assigns the City Inspectorate and the Department of Finance, according to their functions and duties, to strengthen inspection and supervision of the arrangement, organization, and handling of public offices and assets of agencies, units, and organizations under the city's management; city departments, boards, and units under the city's direct control, and the People's Committees of communes and wards, are to proactively conduct self-inspections of the arrangement, organization, and handling of public offices and assets of agencies, units, and organizations under their management; and propose disciplinary action against collectives and individuals who are slow or fail to comply with legal regulations.

For properties and land already allocated for use as offices or operational facilities, if shortcomings arise after a period of operation, the People's Committee of the commune or ward shall continue to make arrangements to ensure working conditions for officials, civil servants, and employees in accordance with the law; while simultaneously providing the best possible public services and handling administrative procedures for citizens and businesses.

Review all aspects of the management and use of public assets at agencies, organizations, and units under their management after the restructuring and streamlining of the administrative apparatus and the reorganization of administrative units; in cases of lending, business activities, leasing, joint ventures, or partnerships that violate the law, immediately terminate the improper use, and at the same time rectify and handle the responsibility of the collective and individuals involved in the improper use of public assets.

The Department of Finance monitors, urges, inspects, and supervises the arrangement and handling of surplus public offices and assets after the reorganization of administrative units at departments, agencies, and units under the city and the People's Committees of communes and wards; updates difficulties and obstacles arising during the implementation process to promptly guide and handle them within its authority or report to the competent authority for consideration and direction.
