Hotels in Nha Trang violated construction regulations and built extra floors: Who is responsible?

53 hotels violated regulations by building extra floors and arbitrarily changing their intended use.

As Thanh Nien newspaper reported, according to reports from relevant authorities, there are a total of 67 construction violations in Khanh Hoa province. In Nha Trang City alone, 53 hotels violated regulations by building extra floors, adding mezzanines and basements, and arbitrarily altering the building's function. To date, most of these violations, despite having paid fines, have not been rectified.

Nha Trang City has numerous hotels that violate construction regulations.

Of the 67 illegal constructions, 40 were licensed by the Department of Construction, while the remaining 27 were licensed by the district-level People's Committee and the Van Phong Economic Zone Management Board.

Previously, on November 20, 2023, in a document sent to the Department of Construction and relevant units and localities, the Vice Chairman of the People's Committee of Khanh Hoa province, Tran Hoa Nam, requested the urgent inspection and strict handling of construction projects violating construction regulations according to the law. At the same time, he emphasized preventing recurrence of violations in new construction projects.

The Vice Chairman of the People's Committee of Khanh Hoa province also instructed the Department of Construction to compile and report the results of the implementation to the Provincial People's Committee before December 29, 2023. However, more than 10 days have passed since the deadline, but the Khanh Hoa Department of Construction has still not submitted a report to the Provincial People's Committee.

Ton Dan Street in Loc Tho Ward is less than 200 meters long and only about 3 meters wide, yet it is densely packed with hotels. Five hotels here have already violated construction regulations.

Speaking to Thanh Nien newspaper , Mr. Le Minh Tien, Deputy Director of the Khanh Hoa Department of Construction, said that due to the large volume of projects and their duration across different periods and stages, the Department had submitted a request to the Provincial People's Committee to extend the reporting deadline.

When asked by a reporter from Thanh Nien newspaper whether investors would be required to rectify or dismantle the violating structures, Mr. Tien stated that this would require reviewing each construction project individually before any specific action could be taken. However, according to regulations, violating structures will be required to rectify the situation, but only according to the prescribed procedures and timeframe. "After the inspection and handling results are available, the department will provide specific information," Mr. Tien said.

Sun City Hotel (Ton Dan Street, Loc Tho Ward) has added 4 floors, increasing its height from 12 to 16 floors.

A series of hotels have been renovated from residential buildings, exceeding the permitted number of floors.

Speaking to a reporter from Thanh Nien newspaper, Mr. Tran Hoa Nam, Vice Chairman of the People's Committee of Khanh Hoa province, said that the province has directed that violations be strictly handled according to the law. "Depending on the severity of the violation at each construction site, demolition and rectification will be mandatory," Mr. Nam emphasized.

According to the Vice Chairman of the People's Committee of Khanh Hoa province, responsibility for these violations lies with various levels of management, from the investors of urban areas and the People's Committees of districts to the Department of Construction. "Specific responsibilities cannot be determined at this time. That will be addressed in a separate section after the report on the inspection and handling of the violating constructions is available," Mr. Nam stated.

Lucky Sun Hotel (Tran Phu Street, Loc Tho Ward) has added 5 floors, including 4 above-ground floors and 1 basement floor.

Previously, Thanh Nien newspaper reported that authorities in Khanh Hoa province, during fire safety inspections, discovered a number of hotels in Nha Trang City that had been renovated from residential buildings and constructed beyond the permitted number of floors. These structures were mostly hotels and restaurants.

Specifically, the Muong Thanh Luxury Nha Trang Hotel (60 Tran Phu Street, Loc Tho Ward) renovated the 46th floor into 10 apartments; the Oceanus luxury apartment hotel (OC2 building, Bai Duong area, Vinh Phuoc Ward) added 4 apartments to the technical area on the 41st floor; the Novotel Hotel (50 Tran Phu Street, Loc Tho Ward), owned by Hai Yen Co., Ltd., added floors 16 and 17; the Lucky Sun Hotel (Tran Phu Street, Loc Tho Ward) added 5 floors, including 4 above-ground floors and 1 basement floor; the Barcelona Hotel (Nguyen Thien Thuat Street, Loc Tho Ward) added 1 floor, making it 12 floors high, and changed the function of the rooftop to a swimming pool and technical area; the Sun City Hotel (Ton Dan Street, Loc Tho Ward) added 4 floors, from 12 floors to 16 floors. Maple Hotel & Apartment (Ton Dan Street, Loc Tho Ward) changed the function of floors 1, 2, and 3; Aroma Nha Trang Boutique Hotel (Tran Quang Khai Street, Loc Tho Ward) added 4 floors, from 11 to 15 floors...
