Quang Ninh has recently attracted many urban infrastructure development projects. However, there are still some projects that have revealed shortcomings, such as investors and project owners lacking capacity, land acquisition policies that have not kept up with life, the state management role of localities, departments and branches is not thorough, and the awareness of a part of the people is still limited...; leading to slow progress, causing many consequences.

Consequences

For many years now, the Ha Long University Project and the Urban Area and Auxiliary Services in Nam Khe Ward (Uong Bi City) have not been implemented on schedule, causing serious impacts on the lives of people in the project area. This situation is making the urban area more shabby, making the lives of hundreds of people very difficult.

Many households in the planning area of ​​Ha Long University Project and Urban Area, Auxiliary Services in Nam Khe Ward had to move elsewhere because they were not allowed to build houses.

For many years, Ms. Bui Thi Lien's family (Nam Tan area, Nam Khe ward) has had to live in a dilapidated, leaky house . The reason the family cannot repair or rebuild the house is because of regulations for houses in the planning area. The slow implementation of the project has caused negative consequences for the environment, health and lives of the people. Ms. Lien shared: "My house is now degraded, when it rains and storms, it leaks, floods, and is at risk of collapsing at any time. I hope the government will soon resolve the issue so that our people can repair their houses and stabilize their lives."

The situation of Ms. Lien’s family is also the common situation of many households here. For nearly 10 years, the lives of hundreds of people in Nam Tan area have been in a vicious circle. They want to sell their houses and land to move elsewhere but no one buys them; they want to mortgage their houses and land but no bank accepts them… The reason is that the land is in the area affected by the project.

The project of Ha Long University and the urban area and auxiliary services in Nam Khe ward was approved by the province with an area of ​​59 hectares. Recently, the province has allowed research units to expand the planning to 111.13 hectares. Thus, the number of affected households has also increased. People are looking forward to the province's early approval of the planning and announcement so that they know the boundaries, feel secure to stabilize their lives and agricultural production.

Ms. Dang Thi Khanh's household (zone 6, Quang Yen ward) cannot be relocated due to problems with site clearance.

Similar to many years ago, some households affected by the Lien Minh Dam Residential Area Infrastructure Investment and Construction Project (Quang Yen Ward, Quang Yen Town) also lived in difficult circumstances due to problems with site clearance.

This project was implemented in September 2004, with Tin Nghia Construction Joint Stock Company as the investor; in December 2017, the new investor was Thanh Thang Construction Investment Joint Stock Company. The total planned land area of ​​the project is over 57,000m2 , the project completion time is until the end of June 2009. However, up to now, the investor has only leveled about 1/3 of the area, constructing infrastructure for this leveled area including 150 plots of land. All of these plots have been transferred by the investor, 50 plots have been built for living. Currently, the remaining land area of ​​the project is stuck in the land acquisition work related to 6 households. Although the town has allocated land to resettle these households, the investor has ignored the requests of the local government after many times working together to complete the site clearance work, causing 6 households to live in a situation of "unable to leave, unable to stay".

For many years, Ms. Dang Thi Khanh's household (Zone 6, Quang Yen Ward) has had to live in a dilapidated house, with furniture such as refrigerators, cupboards, etc. having to be placed high. Ms. Khanh said: "Every time it rains, the house floods, I'm worried it will collapse, but I haven't received compensation to move." Currently, more than 100 households in the Dam Lien Minh residential area have built billion-dollar villas and townhouses, but they are also in a state of "restlessness". After nearly 20 years of implementation, the project still has unfinished traffic infrastructure, electricity and water systems, green parks, lakes, etc., and has not been granted a land use right certificate.

Ms. Vu Thi Tuyen (Lien Minh lagoon residential area) said that she bought a piece of land in the project area in 2014, and in 2017 built a house on an area of ​​over 90 square meters , but has not yet been granted a red book. "For nearly ten years, the whole area has petitioned the investor to complete the infrastructure to grant red books to the people, but nothing has happened. The electricity and water are not complete, forcing households to ask the neighboring residential area to install them, which is very inconvenient" - Ms. Tuyen was upset.

Recalling slow-progressing projects

Faced with the above situation, the province has requested localities to review projects and propose to withdraw and redirect investment depending on the level. According to statistics, before January 1, 2019, there were 175 projects that had allocated land and leased land; of which 123 projects were basically completed, 8 projects were behind schedule for less than 2 years, 21 projects were behind schedule for 2-5 years, and 23 projects were behind schedule for more than 5 years.

The collective housing project of Viglacera Clinker Brick Joint Stock Company (Dong Trieu Town) has been behind schedule for many years.

In order to strengthen the state management of land as well as early detection, on that basis, take timely measures to prevent violations of the law; on November 14, 2022, the Provincial People's Committee issued Document No. 5858/UBND, assigning the Provincial Inspectorate to advise on a plan for large-scale thematic inspections in 2023 for 175 projects. Accordingly, 11 projects chaired by the Provincial Inspectorate are complex in nature: 4 projects are being inspected in Van Don district, surveying and preparing for inspection for 3 projects in Mong Cai city, assigning tasks and inspecting in the third and fourth quarters of 2023 for 4 projects in Ha Long city; departments and branches inspect 72 projects related to works that are not in accordance with planning, waiting for planning adjustment, not yet fulfilled financial obligations, problems with land allocation, land lease, water surface allocation, aquaculture, etc.; Localities inspected 23 projects...

From November 4, 2022 to April 26, 2023, the Provincial People's Committee issued a decision to reclaim land for 10 projects, with a total area of ​​43.87 hectares; including 1 project violating the Land Law (ancient film studio project in Thuong Yen Cong commune, Uong Bi city) of Vietnam Tinh Hoa Joint Stock Company, 9 projects whose land tax period has expired and voluntarily returned the land.

The historical film studio project in Thuong Yen Cong commune (Uong Bi city) was revoked due to violation of the Land Law.

There are 33 projects that have been approved for investment but have not been allocated land (19 projects have been selected for investors before 2019; 14 projects were approved after 2019) with a delay of less than 2 years. Up to this point, the Department of Planning and Investment has issued a notice to terminate investment activities for the medicinal plant planting project in Khe Can village (Dong Son commune, Ha Long city) of Duc Minh Medical Joint Stock Company.

Departments, branches and localities have actively reviewed, urged and strictly handled violations, ensuring compliance with legal regulations. To continue handling projects that are behind schedule, all levels, branches and localities need to step up inspection, review to clarify responsibilities, causes and have decisive measures to handle each specific project. Thereby attaching personal responsibility to local leaders and related departments and branches. Localities are interested in focusing on removing difficulties and obstacles in compensation and site clearance work to promptly hand over land to investors for implementation.
