Resolutely handle slow-progressing projects

Quang Ninh has attracted many urban infrastructure development projects in recent years. However, some projects have revealed shortcomings, such as incompetent investors and project owners, land clearance policies that have not kept pace with real-life situations, a lack of thorough management by local authorities and departments, and limited awareness among some citizens…; leading to delays and numerous negative consequences.

The consequences

For many years, the Ha Long University Project and the urban area with supporting services in Nam Khe ward (Uong Bi city) have been implemented behind schedule, seriously affecting the lives of people in the project area. This situation is making the urban landscape even more unsightly and causing many difficulties in the daily lives of hundreds of residents.

Many households within the planned area for the Ha Long University Project and the urban and supporting service zone in Nam Khe ward have had to move elsewhere because they are not allowed to build houses.

Ms. Bui Thi Lien's family (Nam Tan area, Nam Khe ward) has been living in a dilapidated, leaky house for many years . The reason they cannot repair or rebuild is due to regulations for houses located within planned development areas. The delayed implementation of the project has negative consequences for the environment, health, and lives of the residents. Ms. Lien shared: "My house is now dilapidated; when it rains heavily, it leaks, floods, and there's a risk of it collapsing at any moment. I hope the authorities will resolve this soon so that we can repair our houses and stabilize our lives."

The situation of Ms. Lien's family is also the common plight of many households here. For nearly 10 years, the lives of hundreds of people in the Nam Tan area have been trapped in a vicious cycle. They want to sell their houses and land to move elsewhere, but no one will buy them; they want to mortgage their houses and land, but no bank will accept them… The reason is that the land is located in an area affected by the project.

The Ha Long University and urban area project with supporting services in Nam Khe ward was approved by the province with an area of ​​59 hectares. Recently, the province has allowed relevant units to study expanding the plan to 111.13 hectares. This means the number of affected households has also increased significantly. Residents are eagerly awaiting the province's early approval and announcement of the plan so they know the boundaries, can feel secure, and can continue their lives and agricultural production.

Ms. Dang Thi Khanh's household (Zone 6, Quang Yen Ward) has not been able to relocate due to obstacles in land clearance work.

Similarly, for many years now, some households affected by the Lien Minh Lagoon residential area infrastructure construction and business investment project (Quang Yen ward, Quang Yen town) have also been living in difficult circumstances due to obstacles in land clearance.

This project was launched in September 2004, with Tin Nghia Construction Joint Stock Company as the investor; in December 2017, the investor was changed to Thanh Thang Construction Investment Joint Stock Company. The total planned land area of ​​the project is over 57,000 , with a completion deadline of June 2009. However, to date, the investor has only leveled about one-third of the area and constructed infrastructure for 150 plots of land. All of these plots have been transferred by the investor, with 50 plots already having residential buildings constructed. Currently, the remaining land area of ​​the project is facing difficulties in land clearance involving 6 households. Although the town had allocated land for the resettlement of these households, the investor ignored the local authorities' requests after numerous meetings to finalize the land clearance process, leaving six households in a predicament where they could neither leave nor stay.

For many years, Ms. Dang Thi Khanh's household (Zone 6, Quang Yen Ward) has been living in a dilapidated house, with household items like refrigerators and kitchen cabinets having to be placed on elevated platforms. Ms. Khanh said: "Every time it rains, the house floods, and I'm worried it will collapse, but I haven't received any compensation to relocate." Currently, more than 100 households in the Lien Minh lagoon residential area, who have built multi-million dollar villas and townhouses, are also in a state of anxiety. After nearly 20 years of implementation, the project remains unfinished, with incomplete infrastructure including transportation, electricity and water systems, parks, and lakes, and no land use certificates have been issued.

Ms. Vu Thi Tuyen (from Lien Minh Lagoon residential area) said that she bought a plot of land in the project area in 2014 and built a house on it in 2017, covering an area of ​​over 90 square meters , but has not yet received a land ownership certificate. “For nearly a decade, the entire area has been petitioning the investor to complete the infrastructure so that land ownership certificates can be issued to residents, but nothing has materialized. The incomplete electricity and water supply forces households to rely on connections from the neighboring residential area, which is very inconvenient,” Ms. Tuyen complained.

Revoke projects that are behind schedule.

In response to this situation, the province has requested localities to review projects and propose the revocation or redirection of investment depending on the severity of the delay. According to statistics, before January 1, 2019, there were 175 projects that had been allocated or leased land; of which 123 projects were basically completed, 8 projects were delayed by less than 2 years, 21 projects were delayed by 2-5 years, and 23 projects were delayed by more than 5 years.

The collective housing project of Viglacera Clinker Brick Joint Stock Company (Dong Trieu Town) has been delayed for many years.

In order to strengthen state management of land and to detect and promptly handle violations of the law, on November 14, 2022, the Provincial People's Committee issued Document No. 5858/UBND, assigning the Provincial Inspectorate to advise on a comprehensive thematic inspection plan for 175 projects in 2023. Accordingly, 11 projects under the Provincial Inspectorate's supervision are complex in nature: 4 projects in Van Don district are currently under inspection; surveys are being conducted to prepare for inspection of 3 projects in Mong Cai city; tasks are being allocated and inspections will be conducted in the third and fourth quarters of 2023 for 4 projects in Ha Long city; and various departments and agencies are inspecting 72 projects related to constructions that violate planning regulations, are awaiting planning adjustments, have not fulfilled financial obligations, and have obstacles in land allocation, land leasing, water surface allocation, and aquaculture... Local authorities inspected 23 projects...

From November 4, 2022 to April 26, 2023, the Provincial People's Committee issued decisions to revoke land for 10 projects, totaling 43.87 hectares; including 1 project violating the Land Law (the historical film studio project in Thuong Yen Cong commune, Uong Bi city) of Vietnam Tinh Hoa Joint Stock Company, and 9 projects whose land tax period had expired and voluntarily returned the land.

The project for a historical drama film studio in Thuong Yen Cong commune (Uong Bi city) has been revoked due to violations of the Land Law.

Thirty-three projects have received investment approval but have not yet been allocated land (19 projects had their investors selected before 2019; 14 projects were approved after 2019) and are behind schedule by less than two years. To date, the Department of Planning and Investment has issued a notice terminating the investment activities for the medicinal plant cultivation project in Khe Can village (Dong Son commune, Ha Long city) by Duc Minh Medical Joint Stock Company.

Departments, agencies, and localities have actively reviewed, urged, and strictly handled violations, ensuring compliance with the law. To continue addressing delayed projects, all levels, sectors, and localities need to strengthen inspections and reviews to clarify responsibilities, causes, and take decisive measures to resolve each specific project. This will involve holding the heads of localities and relevant departments and agencies accountable. Localities should focus on resolving difficulties and obstacles in land compensation and clearance to expedite land handover to investors for project implementation.
