The report stated that the Law on Cadres and Civil Servants in 2025 has completed the basic contents related to the recruitment, use and management of civil servants, such as converting the method of managing cadres and civil servants according to job positions, thereby clearly stipulating that the recruitment, arrangement and use of cadres and civil servants must be based on the requirements of the job position and the capacity, results and effectiveness of performing the tasks of cadres and civil servants. Innovating the recruitment of civil servants in the direction that the selected person must immediately meet the requirements of the job position, after being recruited, the salary will be assigned to the civil servant rank corresponding to the recruited job position and will not have to undergo an internship; the mechanism to attract outstanding and outstanding experts, scientists , businessmen, excellent graduates, and talented young scientists.
According to the current policy of the Politburo and Secretariat, reviewing and perfecting job positions is an issue that needs to be carried out to meet the requirements of organizing the two-level local government apparatus, ensuring effectiveness and efficiency, not affecting the normal operations of agencies, organizations, units and meeting the requirements of serving people and businesses.
The purpose of issuing the decree is to specify the contents of civil servant job positions; it is an important basis for salary payment and innovation in recruitment, evaluation, planning, training and fostering of civil servants according to job positions. At the same time, there is a competitive mechanism to improve the quality of cadres, civil servants and public employees and move towards abolishing the "lifetime" tenure system.
On that basis, the draft builds a unified list with 6 groups: leadership positions, specialized professional expertise, shared professional expertise, support - service, positions under the provincial People's Council and commune-level civil servant positions. The draft clearly stipulates the proportion of civil servants arranged according to each position group at the central and local levels.

The purpose of issuing this decree is to provide detailed regulations on civil servant job positions.
Accordingly, at the Central level, based on the list of framework job positions prescribed by the Government and the functions and tasks prescribed by competent authorities, the Central Ministries and branches determine the positions of civil servants used in agencies and organizations under their management, as a basis for recruiting, using, managing civil servants and determining the payroll.
At the local level, based on the list of job positions according to the framework prescribed by the Government and the functions and tasks prescribed in the Law on Organization of Local Government 2025; Decrees on decentralization and delegation in the field of state management of ministries and branches to localities; Decrees of the Government and Circulars of the Ministry managing the sector and field guiding the functions, tasks and powers according to the sector and field under the management scope of specialized agencies under the People's Committees at the provincial and communal levels; The level of modernization of offices, equipment, working means, application of science and technology, digital transformation, geographical location, nature, scale, population structure, economic growth rate and urbanization, socio-economic development strategy, People's Committees of provinces and centrally run cities determine the positions of civil servants used in specialized agencies, other administrative agencies and organizations and People's Committees at the commune level under their management, as a basis for recruitment, use, management of civil servants and determination of payroll.
To implement this content, agencies and organizations will proactively determine the specific job positions used in their agencies and organizations based on the list of job positions and functions, tasks and powers assigned according to regulations of competent authorities without having to wait for guidance documents from the Ministry managing the industry or field as previously prescribed.
According to the draft, by December 31, 2026 at the latest, ministries, ministerial-level agencies, organizations established by the Government or the Prime Minister that are not public service units (in cases where they are assigned the authority to manage civil servants), and People's Committees of provinces and centrally run cities must complete and issue decisions approving job positions of agencies and organizations under their management as prescribed in this Decree to replace previously issued decisions on job positions, as a basis for arranging civil servants according to job positions. During this period, previously issued decisions approving job positions will continue to be implemented.
By July 1, 2027 at the latest, ministries, ministerial-level agencies, organizations established by the Government or the Prime Minister that are not public service units (in cases where they are assigned the authority to manage civil servants), and People's Committees of provinces and centrally run cities must complete the arrangement and ranking of civil servants under their management authority to the approved job positions according to the provisions of this Decree.
In case a civil servant does not fully meet the requirements of the expected job position, the head of the agency employing the civil servant is responsible for temporarily arranging a job position corresponding to the civil servant rank currently assigned within 24 months to complete.
After this period, if the requirements are not met, consider arranging to a job position with a lower grade or report to the civil servant management agency to decide to arrange to another employing agency within the scope of management where there is a job position suitable to the current grade or a grade lower than the current grade.
In case it is not possible to transfer or arrange to a job position with a lower rank than the current rank held at another employing agency, consider streamlining the payroll according to the provisions of law.
