The People's Air Defense Law provides comprehensive regulations for both flying taxis and flying motorbikes.

Continuing the working program at the 8th Session, this afternoon, October 30, the National Assembly discussed in the hall the draft Law on People's Air Defense.

This law stipulates the principles, tasks, forces, and operations of people's air defense; the management of unmanned aircraft and other flying vehicles, and ensuring air defense safety; and the resources, regulations, policies, rights, obligations, and responsibilities of agencies, organizations, enterprises, and individuals regarding people's air defense.

Presenting the report explaining, receiving feedback, and revising the draft law, the Chairman of the National Defense and Security Committee, Le Tan Toi, stated that some opinions suggested a more complete explanation of the concept of "unmanned aircraft" and referencing international experience to refine the concept, making it comprehensive enough to include flying taxis and flying motorcycles to facilitate implementation.

Based on the opinions of delegates, and after studying the concepts of several countries and the regulations in the 1944 Convention on Civil Aviation (which uses the term "unmanned aircraft" – Article 8 of the Convention), the Standing Committee of the National Assembly has revised this concept to ensure it is appropriate, complete, and comprehensive, encompassing other unmanned flying devices that may exist in the future, such as flying taxis and flying motorcycles.

According to the draft, an “unmanned aircraft” is an aircraft whose flight control and maintenance do not require direct control by a pilot on board.

"Other flying vehicles" include balloons, flying models, parachutes, kites (except for traditional flying kites) and other flying devices with or without a pilot that are not aircraft or unmanned aircraft.

The draft also stipulates that organizations and individuals permitted to trade in unmanned aircraft, other flying vehicles, aircraft engines, aircraft propellers, and equipment and devices for unmanned aircraft and other flying vehicles are allowed to import, export, temporarily import for re-export, and temporarily export for re-import unmanned aircraft, other flying vehicles, aircraft engines, aircraft propellers, and equipment and devices for unmanned aircraft and other flying vehicles.

The Minister of National Defence and the Minister of Public Security grant licenses for the import and export of unmanned aerial vehicles (UAVs), other flying vehicles, aircraft engines, aircraft propellers, and equipment and devices for UAVs and other flying vehicles serving the national defence and security tasks of the Ministry of National Defence and the Ministry of Public Security.

The Law also specifically stipulates conditions for organizations and individuals conducting business activities in unmanned aircraft, other flying vehicles, aircraft engines, aircraft propellers and equipment and devices of unmanned aircraft and other flying vehicles.

"Drones and other flying vehicles must be registered according to Government regulations before being put into operation and use," according to the draft law.

The law also prohibits the manufacture, testing, production, repair, maintenance, trading, export, import, temporary import for re-export, temporary export for re-import, ownership, operation, and use of unmanned aircraft, other flying vehicles, aircraft engines, aircraft propellers, and equipment and devices of unmanned aircraft and other flying vehicles in violation of the law.

It is also prohibited to use drones or other flying vehicles to carry illegal equipment, weapons, explosives, or prohibited substances, or to propagate, incite, entice, or distort information to sabotage the Party and the State.

Regarding the organization of the people's air defense forces, there are units for suppressing unmanned aircraft and other flying vehicles, as well as the authority and circumstances under which suppression is permitted (i.e., the use of firepower, impulses, or other measures to disrupt the operation of unmanned aircraft and other flying vehicles, disable individual functions, or completely render them inoperable).

After Minister of National Defense Phan Van Giang explained the opinions raised by delegates and concluded the working session, Vice Chairman of the National Assembly Tran Quang Phuong said the draft law is eligible to be submitted to the National Assembly for voting and approval at this session.
