Law amending and supplementing a number of articles of 10 laws related to security and order: Continues to regulate continuous driving time not exceeding 4 hours.

On the morning of December 10th, continuing the program of the Tenth Session, under the chairmanship of National Assembly Chairman Tran Thanh Man and the direction of National Assembly Vice Chairman, Lieutenant General Tran Quang Phuong, the National Assembly voted to pass the Law amending and supplementing a number of articles of 10 laws related to security and order with 425 out of 433 National Assembly deputies present voting in favor, reaching 98.15%.

The Law amending and supplementing a number of articles of 10 laws related to security and order consists of 11 articles and will take effect from July 1, 2026.

According to the Report on the acceptance, explanation, and revision of the draft Law amending and supplementing a number of articles of 10 laws related to security and order, the Government has reviewed and ensured uniformity in the concepts of residence documents, personal identification documents, electronic identity cards, and databases to facilitate citizens and functional forces in carrying out administrative procedures; reviewed and perfected the language, format, and technical presentation of the documents to ensure accuracy, completeness, and consistency when merging the 10 amended and supplemented laws into the current laws.

Regarding amendments and additions to some articles of the Law on Road Traffic Order and Safety, the Government proposes to continue stipulating that continuous driving time should not exceed 4 hours, as this regulation is consistent with international practice. Furthermore, stipulating a continuous driving time of no more than 4 hours allows drivers time to rest, ensuring they maintain alertness and drive safely.

At the same time, the Government has amended Clause 1, Article 64 of the Law on Road Traffic Order and Safety as follows: “ 1. The continuous driving time of a driver shall not exceed 4 hours, except in cases of force majeure or objective obstacles. The working time of a driver in a day and a week shall be in accordance with the provisions of the Labor Code .”

The government will study and incorporate regulations into sub-laws to exclude cases of traffic congestion and force majeure, in order to suit the current traffic situation, especially in large cities, and to ensure the rights of businesses, traders, and workers, contributing to socio-economic development.

The draft law has revised the content related to weekly and daily driving hours to align with reality and ensure compliance with the Labor Code and international practices.

The regulation limiting continuous driving time to no more than 4 hours inherits the provisions of Clause 1, Article 65 of the 2008 Road Traffic Law, which has been implemented stably for many years, is consistent with international experience, and is based on scientific evidence and the psychological, physiological, and health conditions of drivers, especially those driving long-distance cargo and passenger transport vehicles.

Currently, the law only regulates commercial transport drivers because they pose a higher risk of traffic accidents than private drivers. For private drivers, it should initially only be recommended that they not drive for more than 4 hours, and not yet be made mandatory, as many countries around the world do not yet have such regulations for private drivers.

In addition, taking into account the opinions of National Assembly deputies, the Government has revised Clause 3, Article 10 of the Law on Road Traffic Order and Safety as follows: “ 3. When transporting children under 10 years old and under 1.35 meters tall in a car, the driver is not allowed to let the child sit in the same row of seats, except for cars with only one row of seats; the driver must use and instruct the use of appropriate safety equipment for children, except for passenger transport vehicles .”

The regulation requiring the installation of driver image recording devices for passenger transport vehicles with fewer than 8 seats (excluding the driver's seat), goods transport vehicles (excluding tractor-trailers), and internal transport vehicles, as stipulated in Clause 2, Article 35 of the Law, will take effect from January 1, 2028.

The regulation requiring the installation of video recording devices in the passenger compartment of passenger transport vehicles with 8 or more seats (excluding the driver's seat), as stipulated in Clause 2, Article 35 of the Law, will take effect from January 1, 2029, and will be implemented according to a roadmap prescribed by the Government.
