
The resolution added a provision stating that in cases where the land price table cannot be applied, the specific land price shall be determined according to the provisions of the Land Law.
The resolution states that the land price for calculating land compensation as stipulated in Clause 2, Article 91 of the Land Law, and the land use fee at the resettlement site as stipulated in Clause 3, Article 111 of the Land Law, shall be calculated according to the land price table and the land price adjustment coefficient specified in this Resolution.
In cases where compensation is provided in the form of on-site residential land and the land price at the compensated location is not included in the land price list, the competent authority shall base its decision on the land price in the land price list for a similar location to determine the land price for calculating land use fees at the resettlement site in the compensation, support, and resettlement plan.

The People's Committee at the commune level is responsible for reporting to the People's Committee at the provincial level to submit to the Provincial People's Council for inclusion in the land price list at the nearest session.
The resolution allows for the deduction of compensation, support, and resettlement funds advanced by investors from land use fees and land lease fees payable, as stipulated in Clause 2, Article 94 of the Land Law, calculated for the entire project and for each land allocation and lease decision.

Notably, Article 12 of the Resolution added the provision that "There will be no organization of the preparation of the 5-year land use plan (2026-2030) for centrally-administered cities, district-level land use plans, district-level annual land use plans, commune-level land use plans, or commune-level land use plans. When localities organize the preparation of adjustments to the provincial plan for the period 2021-2030, with a vision to 2050, they must determine the land use targets allocated by the national land use plan and land use targets based on the local land use needs down to each commune-level administrative unit."
The resolution takes effect from January 1, 2026.
