Mr. Le Minh Tri: "Accepting the game, we must act strongly, not hold back"

(Dan Tri) - Regulations on specialized courts in international financial centers, according to Deputy Head of the Central Internal Affairs Committee Le Minh Tri, are a game and if accepted, must be implemented strongly.

This viewpoint was given by Deputy Head of the Central Internal Affairs Committee Le Minh Tri in the discussion session on the afternoon of December 4 on the draft Law on Specialized Courts at the International Finance Center.

The establishment of an international financial center in Ho Chi Minh City and Da Nang with the goal of attracting international financial resources, according to Mr. Tri, involves having a specialized court at this center to help investors feel secure when disputes arise.

“If people do not feel secure when investing here and there is a dispute, they will not come. Therefore, for the financial center to operate, it must involve this specialized court,” emphasized the Deputy Head of the Central Internal Affairs Committee.

In fact, he said that some countries have been implementing this model for a long time and it has been effective. If Vietnam implements it now, according to Mr. Tri, it must be equal or superior, otherwise it will fail because it "does not solve any problems".

Some people have raised the issue that the implementation must be in accordance with the Constitution and must ensure national jurisdiction. But in reality, Mr. Tri emphasized that this is a game, and countries do not follow the regulations of any country but follow the international common law system.

“Investors will look at this court to choose, and after choosing the court, they will choose the law they want to apply, then choose famous, prestigious judges with extensive experience in this field,” Mr. Le Minh Tri emphasized. He added that if we want investors to feel secure and invest in the financial center, we must satisfy these requirements.

“If we do it, we have to accept this superior game. We imagine this game like we build a specialized hospital, and when there is a patient - that is, a dispute - we will sign a contract to invite the best specialist to operate, and after the operation, they will leave,” Mr. Tri compared and emphasized that this model is “unbinding”.

With that understanding, he affirmed that if one wants to do something, one must excel and follow common practices. Doing things one's own way in the "gradual innovation" style will not be able to compete.

Or as for the regulations related to foreign judges, Mr. Tri also thinks that it needs to be "opened up", because in reality, Vietnamese judges cannot meet the English proficiency requirements for adjudication. Not to mention that investors will not trust us and will not choose us, so the option that Mr. Tri mentioned is to accept hiring foreign judges as the main thing, then gradually train Vietnamese judges.

The direction he emphasized was to do it and then continue to expand. “This is a very new and difficult problem, but once you accept this game, you have to do it strongly to succeed. If you do it half-heartedly, you will definitely not succeed,” Mr. Tri stated his opinion.

With the support of National Assembly delegates, the Deputy Head of the Central Internal Affairs Committee reaffirmed that the approach must be bold, done and then supplemented gradually, and cannot wait for "everything to be ready".
