
Responding to the development requirements of Ho Chi Minh City after the merger
The draft Resolution of the National Assembly amending and supplementing a number of articles of Resolution No. 98/2023/QH15 on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City, presented by Deputy Prime Minister Bui Thanh Son, said that the amendment and supplementation of the Resolution aims to continue perfecting the legal basis, ensuring specific, superior, strict, feasible and more effective mechanisms and policies.
Thereby, meeting the urgent requirements in attracting strategic investors, mobilizing domestic and foreign resources for development investment, meeting the requirements and development orientation of the City after the merger; overcoming difficulties, obstacles and inadequacies arising in the process of implementing Resolution No. 98/2023/QH15...

The draft Resolution consists of 3 articles: Article 1 of the draft Resolution consists of 13 clauses, amending and supplementing 6 articles of Resolution No. 98/2023/QH15 (Articles 1, 4, 6, 7, 11, 12), adding 01 article (Article 7a); Article 2 of the draft Resolution consists of 2 clauses regulating the effective date and Article 3 of the draft Resolution consists of 4 clauses regulating transitional provisions.
The Draft Resolution adds the content on the establishment and operation of the Ho Chi Minh City Free Trade Zone to the scope of regulation. At the same time, it removes the regulation on Thu Duc City from the scope of regulation due to the implementation of a two-level local government.
The Draft Resolution also amends and supplements Clause 2, Article 4 on policies for urban development models oriented towards public transport development (TOD); Amends and supplements Clause 7, Article 6 on urban, resource and environmental management; Amends and supplements Article 7 on priority industries and occupations to attract strategic investors to the City...
Comprehensive assessment of policy impact
The verification report presented by Chairman of the Economic and Financial Committee Phan Van Mai stated that the Committee and the Standing Committees of the National Assembly agencies agreed with the Government's proposal on the necessity of amending and supplementing a number of articles of Resolution No. 98.

At the same time, it is believed that the amendment and supplementation of a number of articles of Resolution No. 98 is to be consistent with the arrangement of the apparatus and operation of the two-level local government; to promote the potential, strengths, and advantages of expanding the scale and administrative boundaries of Ho Chi Minh City. Thereby, contributing to the realization of the target of double-digit economic growth in the period of 2026-2030.
Regarding the scope of policies and viewpoints and principles for amending and supplementing a number of articles of Resolution No. 98, the Committee finds that the scope of policies proposed for amendment and supplement is important and urgent, but spread across many areas; many regulations are different from current laws and Laws and Resolutions being submitted to the National Assembly for consideration and amendment...; Many policies proposed for amendment and supplement have direct impacts on the state budget, land use management and public assets...
To ensure consistency and feasibility, the Committee recommends that the Government direct a thorough and comprehensive review and assessment of the impact of the proposed policy amendments and supplements. At the same time, it should be noted that it is necessary to ensure compliance with the Constitution, international treaties, and national defense and security.

Mechanisms and policies for amendment and supplementation need to be focused, have a focus, and key points, avoid spreading, and must be truly breakthrough and outstanding; ensure unified management of the Central Government along with strengthening decentralization; limit negative impacts on the rights and interests of the political party and the people...
In addition, only regulate the contents that have been carefully assessed for their truly necessary impacts, are truly effective, and achieve the required goals, with special attention paid to policies affecting state budget revenue and expenditure, affecting the leading role of the central budget and resources to ensure policy implementation and people's rights...
There are opinions suggesting that the amendment and supplementation of specific mechanisms and policies in Resolution No. 98 should be considered and evaluated in conjunction with the Plan, goals and orientations for socio-economic development of the City after the merger on the basis of the Resolution of the City Party Congress in the coming period, ensuring the removal of difficulties, the addition of appropriate mechanisms and policies, and meeting the goals.
