The National Assembly "finalized" that VNeID has the same value as a criminal record certificate from July 1, 2026.

On the afternoon of December 5, the National Assembly voted to pass the draft Law amending and supplementing a number of articles of the Law on Judicial Records. The law will take effect from July 1, 2026.

People are not required to provide criminal record certificate number 2.

The newly passed law stipulates that criminal record information includes information on criminal records, prohibitions on holding positions, establishing and managing enterprises and cooperatives in cases where enterprises and cooperatives are declared bankrupt by the court.

The competent authority to issue the card includes the Department of Professional Records of the Ministry of Public Security and the provincial and municipal police.

Vietnamese citizens and foreigners who have resided or are residing in Vietnam and are 16 years of age or older have the right to request competent authorities to issue their criminal records.

The certificate issued to individuals includes: criminal record certificate No. 1 and certificate No. 2.

Criminal record information and criminal record certificates are managed and used in accordance with the law on personal data protection and sensitive personal data.

In particular, agencies and organizations are not allowed to request individuals to provide information on criminal records. If needed, units can exploit, use, and connect through data sharing from the Criminal Records Database and the National Population Database.

Agencies, organizations and individuals are only required to provide Criminal Record Certificate No. 1 in cases where it is prescribed by law, resolution of the National Assembly, ordinance, resolution of the National Assembly Standing Committee or decree, resolution of the Government .

Criminal record information is only for the purpose of recruitment, licensing, and practice certificates for professions related to national defense, security, social order and safety, health, or to protect the interests of the State...

Criminal record certificate No. 2 is used to prove whether an individual has a criminal record or not, including expunged and unexpunged criminal records, used for purposes such as studying abroad, settling down, marrying a foreigner or when requested by the prosecution agency to serve the investigation and trial.

This form contains complete information on the individual's convictions and whether he/she is prohibited from holding office by a Court decision. Its main purpose is to assist the prosecution agency in the investigation, prosecution and trial.

In addition, individuals can use it to prove whether they have a criminal record or not and the status of execution of the sentence; carry out procedures abroad such as applying for scholarships, settlement, visas, naturalization; carry out procedures to marry a foreigner or apply for a work permit.

With the provisions of the recently passed Law, agencies do not have the right to request citizens to provide Form No. 2. This form is only used when requested by the prosecution agency to serve the prosecution work.

Criminal records are issued in electronic or paper form.

Explaining before the National Assembly voted, Minister of Public Security Luong Tam Quang said that the ballots are issued in electronic or paper form and have the same legal value.

Once the electronic criminal record certificate has been issued, the citizen's criminal record information is updated and displayed on VNeID. This information is considered an available information field similar to full name and date of birth.

Criminal record information displayed on VNeID has the same legal value as a Criminal Record Certificate; individuals do not need to request a Criminal Record Certificate when needed. This creates maximum convenience for people to use the service anytime, anywhere. Criminal record information displayed on the application and the electronic Criminal Record Certificate is authenticated to ensure security and prevent counterfeiting.

Regarding the procedures and time for issuing criminal records, the Minister of Public Security said that the Government accepted and adjusted the regulations on procedures for issuing criminal records online to institutionalize the policy on development, application of science, technology, innovation and digital transformation.

Only in some cases, foreigners and those who do not have an electronic identification can request a card directly or via postal service. Individuals can authorize another person to request a card (for both types of cards). The time limit for issuing a card is reduced to 5 working days.
