The National Assembly has for the first time passed the Artificial Intelligence Law, requiring labeling of AI products.

Audio, images, and videos created or edited using artificial intelligence (AI) systems to simulate or mimic the appearance or voice of real people or to recreate real-world events must be labeled.

With a majority vote, on the afternoon of December 10th, the National Assembly for the first time passed the Law on Artificial Intelligence, which includes many regulations on the research, development, provision, deployment, and use of artificial intelligence (AI) systems...

Labeling AI products in a way that makes them easily distinguishable from real content.

The law includes specific provisions regarding transparency responsibilities related to AI products.

Accordingly, the provider guarantees that the artificial intelligence system interacting directly with humans is designed and operated in such a way that users are aware they are interacting with the system, unless otherwise provided by law.

In addition, ensure that audio, visual, and video content generated by artificial intelligence systems is tagged in machine-readable formats as prescribed by the Government.

The implementing party is responsible for clearly notifying the public when providing text, audio, images, or videos created or edited using artificial intelligence systems if such content is likely to cause confusion regarding the authenticity of events or individuals, unless otherwise provided by law.

On the other hand, there is a responsibility to ensure that audio, images, and videos created or edited using artificial intelligence systems to simulate or mimic the appearance and voice of real people or to recreate real events are clearly labeled to distinguish them from real content.

For products that are cinematographic, artistic, or creative works, the labeling prescribed in this section shall be done in a manner appropriate to ensure that it does not hinder the display, performance, or enjoyment of the work.

Suppliers and implementers are responsible for maintaining transparency as required by this article throughout the process of providing systems, products, or content to users. The Government shall specify the details of notification and labeling procedures.

AI is not a subject of intellectual property rights.

Later that same day, the National Assembly also passed the draft Law amending and supplementing a number of articles of the Intellectual Property Law.

The law stipulates that owners may use their intellectual property rights to conduct civil, commercial, investment, and other transactions in accordance with the laws on science, technology and innovation, intellectual property, and the management and use of public assets.

The State encourages the exploitation of intellectual property rights, and the use of intellectual property rights as capital contributions or collateral for loans in accordance with the laws on investment, enterprises, credit, and other relevant laws.

Notably, regarding policy on artificial intelligence, Minister of Science and Technology Nguyen Manh Hung affirmed that "AI is not a subject of intellectual property rights."

AI products that are created independently, without human involvement, will not be protected in the same way as works of human creation.

Conversely, products created by humans using AI as a tool – similar to a drawing pen or camera – and with human input, editing, and direction, are still considered to have been created or invented by humans.

In cases where humans only provide instructions and AI does most of the work, users have the right to use and commercialize the product, but are not the original creators. The government will be tasked with determining the level of user innovation to apply appropriate protection mechanisms.

Regarding the assessment of intellectual property protection registrations, the Government stated that current law stipulates a re-assessment period equal to two-thirds of the initial assessment period, based on the specific characteristics of the work, the volume of processing, and the professional requirements when re-evaluating dossiers after amendments and additions.
