The National Assembly passed the Law on State of Emergency, effective from January 1, 2026.

On the afternoon of December 3, with 419 deputies in favor, accounting for 88.58% of the total number of deputies, the National Assembly voted to pass the Law on State of Emergency (SEC). The law takes effect from January 1, 2026.

The Law defines and classifies TTKC into three distinct groups: TTKC on disasters; TTKC on national security, social order and safety; and TTKC on national defense.

All response activities must comply with the Constitution, laws of Vietnam and international treaties to which Vietnam is a member; priority must be given to protecting national interests, people's lives and health.

The application of measures in TTKC must be carried out promptly, publicly and transparently. Measures restricting human rights and civil rights must be truly necessary, have clear grounds, be commensurate with the nature and extent of the incident or disaster and be non-discriminatory.

The Law also details the measures to be applied for each type of TTKC. Specifically, when a disaster occurs, the competent authorities will implement civil measures as prescribed in the Law on Civil Defense; evacuate or forcibly relocate people in dangerous areas to safe places; apply price stabilization measures according to the provisions of the law on prices; strictly prohibit cases of smuggling and commercial fraud; temporarily suspend or transfer responsibilities and tasks of heads of agencies, organizations and local authorities who do not perform or do not properly perform their duties and powers.

Among the measures on national security, order and social safety, the law has provisions on strengthening the protection of important and confidential agencies and key leaders; designating airports and ports for aircraft, landing and mooring places for ships, train stations, parking spots for cars and other means of transport; controlling transit flights through the area located in the TTKC; restricting or prohibiting economic and trade transactions with certain countries or organizations related to the TTKC...

The Law also clearly stipulates the State's support policies on taxes, fees, charges, credit, investment, production, business, labor, employment, immigration, and social security to quickly restore production and stabilize life. Response, relief, and support resources include the State budget, civil defense funds, and extra-budgetary State financial funds, national reserves, voluntary contributions, and international support resources.
