Clearly define the responsibilities of airlines when affecting customer rights

On the morning of October 22, during a discussion at Group 15 (including the National Assembly delegations of Phu Tho and Dak Lak provinces), delegates contributed many ideas to perfect the regulations for the draft Law on Vietnam Civil Aviation (amended) and the draft Law on Public Employees (amended) in the current legal system.

Perfecting regulations on compensation for baggage damage

Regarding the amended Law on Civil Aviation of Vietnam, the delegates agreed on the necessity of its promulgation as presented in the Government's submission and the verification report of the Committee on Law and Justice . The amendment of the Law on Civil Aviation of Vietnam is also consistent with the Party's policies and guidelines, and meets current development requirements.

Regarding airport planning in Article 29, National Assembly Deputy Dang Bich Ngoc (Phu Tho) suggested that it is necessary to more clearly stipulate that airport planning must be consistent with national and provincial planning, and be reviewed periodically according to development needs. This would ensure consistency between the Planning Law and the Civil Aviation Law of Vietnam, while also meeting the practical development requirements of civil aviation and supporting socio -economic development.

From another perspective, National Assembly Deputy Nguyen Thi Thu Nguyet (Dak Lak) stated that, according to points a and b, Clause 1, Article 29 of the regulations on airport planning, it is clearly stipulated that airport planning systems are national sectoral plans, while detailed aviation plans are specialized technical plans. The Deputy suggested that the drafting agency should study and ensure consistency between the amended Civil Aviation Law and the Planning Law currently being submitted to the National Assembly for amendment, avoiding overlapping regulations.

Referring to the carrier's responsibility to compensate for damages (Clause 2, Article 64), National Assembly Deputy Nguyen Thi Thu Nguyet said: Clause 2 of this article stipulates that "the carrier is responsible for compensating for damages that occur in the event that checked baggage is destroyed, lost or damaged due to an event occurring on the aircraft, however, the carrier is not responsible if the damage occurs due to an inherent defect of the baggage, quality or defect of the baggage". Such a provision is general, without specific quantification or standards, because when baggage is damaged, what is the basis for determining whether it is due to "defect of the baggage" or "quality or defect of the baggage". Therefore, the delegate recommended that there should be a clear inspection process from the baggage reception stage, helping to determine the specific cause of damage, thereby protecting the rights of passengers.

Also mentioning this content, National Assembly member Dang Bich Ngoc (Phu Tho) reflected on the fact that flight delays and cancellations are still common, especially among low-cost airlines, causing damage and inconvenience to people. The delegate suggested that the draft should clearly stipulate the responsibilities of airlines in compensating and supporting customers, in order to protect the legitimate rights of people and enhance the reputation of the Vietnamese aviation industry.

Priority is given to recruiting civil servants in ethnic minority areas.

Commenting on the draft Law on Civil Servants (amended), National Assembly Deputy Luu Van Duc (Dak Lak) suggested that it is necessary to continue reviewing and ensuring consistency and synchronization in terms of policies (especially ethnic policies) with related laws.

To contribute to further institutionalizing the Party's policy on ethnic policies in the draft, delegate Luu Van Duc suggested: in Clause 5, Article 3, the Drafting Committee should consider having a special priority policy in developing and recruiting civil servants who are ethnic minorities and civil servants with good professional qualifications in ethnic minority and mountainous, island and border areas. In addition, in the regulations on evaluating civil servants (Article 24), there should be evaluation criteria associated with work results, quality of public services and people's satisfaction, overcoming formalities.

Regarding the principles of use, expanding the forms of receiving civil servants who are experts, scientists, talented and experienced people, National Assembly member Dang Bich Ngoc (Phu Tho) said that there should be a mechanism to check and evaluate the actual capacity and ethics when receiving, avoiding taking advantage of policies. Regarding the authority to recruit, the delegate suggested that the draft Law and guiding decrees must review, evaluate, and create conditions for agencies, especially at the commune level, to recruit teachers and some positions related to civil servants, meeting the requirements of the current period.
