Temporarily suspend processing benefits for district and commune officials who are not re-elected or re-appointed.

Kinhtedothi - The Ministry of Interior has requested that from March 5th, agencies, organizations, and units temporarily refrain from processing benefits and policies for commune and district-level officials and civil servants falling under the scope of Decree 177/2024.


The Ministry of Interior has just issued a document to provincial and city Party committees and People's Committees regarding the regulations and policies for officials and civil servants who are not re-elected or re-appointed at Party congresses at all levels.

According to the Ministry of Interior, in implementing Directive No. 35/2024 of the Politburo dated June 14, 2024, on organizing Party congresses at all levels, leading up to the 14th National Congress of the Party, the Government has issued Decree 177/2024 stipulating the regime and policies for officials who are not re-elected, not re-appointed, and officials who resign or retire voluntarily.

However, on February 28, the Politburo and the Secretariat issued Conclusion No. 127 on conducting research and proposing further restructuring of the political system's organizational apparatus. This included a provision stating, "Temporarily suspend the organization of Party congresses at the commune and district levels; after the 11th Plenum of the Central Committee of the Party, the Politburo will issue specific directives and guidance."

Based on that, and in conjunction with proposals from several localities, the Ministry of Interior proposes that from March 5th, agencies, organizations, and units temporarily refrain from processing benefits and policies for commune and district-level officials and civil servants falling under the scope of Decree 177/2024.

For cases where the competent authority had already decided on the entitlement to benefits and policies under Decree 177 before March 5th, these benefits will remain unchanged.

The Ministry of Interior requests that provincial and city Party committees and People's Committees of provinces and centrally-administered cities direct their subordinate agencies, organizations, and units to strictly implement the guidelines.

Decree 177/2024 divides individuals into three groups: Group 1 consists of those ineligible for re-election (less than 30 months remaining until retirement); Group 2 consists of those still eligible for re-election (30-60 months remaining); and Group 3 consists of individuals under the management of the Politburo and the Secretariat.

Accordingly, additional legal grounds will be added to address cases of violations related to early retirement, and regulations will be established for cases where individuals do not violate the rules but wish to retire early… in order to resolve the issues faced by those who have retired recently.

Regarding the system, there are two options: early retirement and waiting to reach the retirement age. Many individuals who are not old enough to be re-elected choose to remain in their jobs, making it difficult to find suitable positions. Therefore, a policy to encourage early retirement is necessary.
