Reviewing the draft Law amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization

On the afternoon of October 10, at the National Assembly House, continuing the 3rd Plenary Session, the Committee on National Defense, Security and Foreign Affairs examined the draft Law amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization.

According to the Draft Law on amending and supplementing a number of articles of the Law on National Defense and Security Industry and Industrial Mobilization, it is very necessary to develop and promulgate the draft Law to promptly institutionalize the Party's policy on building a security industry in the era of national development and growth.

The promulgation of the law aims to synchronously complete the legal system, mechanisms, and policies, create an environment for the development of the security industry to serve the entire political and social system, and aim for export, making a positive contribution to the cause of industrialization, modernization, and national digital transformation. At the same time, promulgate appropriate and specific mechanisms and policies to serve the strong development of the security industry.

The Draft Law consists of 2 Articles, including amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization, including 5 clauses, amending and supplementing 4 articles of the Law, and adding 1 section (including 4 articles) on the National Security Industrial Complex to Chapter II of the Law.

The majority of delegates agreed to promulgate the Law to thoroughly grasp and promptly institutionalize the Party's guidelines, policies, and viewpoints on security industry; develop science , technology, innovation, and national digital transformation; and innovate the work of building and enforcing laws to meet the requirements of national development in the new era.

Delegates stated that the promulgation of the Law is to meet the urgent needs of the practical situation of developing the security industrial system, especially the requirement of forming a National Security Industrial Complex; building specific and appropriate mechanisms and policies, especially on financial resources to remove bottlenecks, barriers and difficulties in the process of researching, developing and applying security industrial products and services.

Delegates basically agreed with the additional regulations on the Security Industry Development Support Fund in the draft Law to promptly institutionalize Conclusion No. 158-KL/TW, dated May 26, 2025 of the Politburo on building a security industry in the era of national growth.

In addition, there are opinions that the new content added at Point a, Clause 1 and Point c, Clause 3, Article 22 on "investment, support for the implementation of programs, projects, activities, acceptance of risks and adventures to build and develop the security industry" is duplicated. Therefore, it is proposed to specify this content more specifically at Point c, Clause 3a, Article 22, similar to the design of Point c, Clause 3, Article 22.

In addition, there are opinions suggesting considering specific regulations on the National Defense Industry Fund serving only financial resources for the national defense industry, and the Security Industry Development Investment Fund serving only financial resources for the security industry to avoid duplication of spending tasks between these two Funds. Adding a separate article on the Security Industry Development Investment Fund to regulate the contents related to this Fund is being proposed to be added to Article 22 to ensure separate distinction between the two Funds...

Concluding the meeting, Deputy Chairman of the Committee on National Defense, Security and Foreign Affairs Nguyen Minh Duc said that the content of the draft Basic Law is consistent with the 2013 Constitution (amended and supplemented by Resolution No. 203/2025/QH15 dated June 16, 2025 of the National Assembly); ensuring legality and consistency with the legal system.

Appreciating the comments that go into the core of the draft Law, the Vice Chairman of the National Defense, Security and Foreign Affairs Committee suggested that the drafting agency and the Standing Committee of the National Defense, Security and Foreign Affairs Committee fully absorb and complete the Submission and the Review Report of the draft Law to submit to the National Assembly Standing Committee for comments before reporting to the National Assembly at the 10th Session.
