On November 3, the National Assembly Standing Committee gave opinions on a draft resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.

Presenting the Government's report, Minister of Natural Resources and Environment Do Duc Duy said the resolution was developed to allow the pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights. This is to continue to concretize the Party's guidelines on continuing to implement the mechanism of self-negotiation between people and enterprises in transferring land use rights to implement urban and commercial housing projects. At the same time, it creates a legal corridor to manage the land use rights market and the real estate market to develop stably, healthily, openly and transparently. The resolution will create favorable conditions for land users and investors to be proactive in implementing commercial housing projects and urban development projects, minimizing the intervention of administrative agencies, limiting the occurrence of administrative procedures, and reducing compliance costs. Limiting the State's land acquisition that can easily lead to people's complaints, contributing to promoting the country's urbanization process, solving the people's need for residential land and housing. This Resolution stipulates pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights nationwide in the following cases: Real estate business organizations receiving land use rights; Real estate business organizations having land use rights; Real estate business organizations having land use rights and receiving land use rights. Real estate business organizations are established by organizations using land to implement commercial housing projects on the area of ​​facilities that must be relocated due to environmental pollution, facilities that must be relocated according to construction and urban planning.

Proposal to assess the current situation of land purchase and speculation

At the same time, it is requested that the Government conduct a detailed and comprehensive assessment of the practical situation of commercial housing development and the effectiveness of land use for commercial housing development in provinces and cities. Assess the current situation of land acquisition and speculation; solutions to limit negative impacts of the pilot. Regarding the criteria for selecting pilot projects, the standing committee requested clarification of the basis for setting the criteria of not exceeding 30% of the additional residential land area during the planning period. Implementation principles for cases where there are many projects proposed for piloting, especially in some localities where many projects are stuck ( Hanoi , Ho Chi Minh City). At the same time, it is recommended to study and stipulate specific criteria for selecting pilot projects, paying attention to the order of priority for pilot selection and project criteria according to the conclusion notice of the National Assembly Standing Committee. There are opinions suggesting not to stipulate this criterion to avoid arising procedures or creating a "request - grant" mechanism during the pilot organization process. Giving opinions in the discussion, some members of the National Assembly Standing Committee said that the Government needs to supplement and provide more information, more carefully assess the current situation and implementation of commercial housing projects. Analyze the main shortcomings and difficulties of localities to have appropriate pilot plans, properly resolve the remaining problems, avoid land speculation or "request - grant project mechanism". Regarding the scope of the pilot, the drafting agency needs to report and clarify the suitability of the scope of the pilot in localities, urban areas, and areas planned for urban development nationwide. Concluding the discussion, Vice Chairman of the National Assembly Nguyen Duc Hai stated that the National Assembly Standing Committee agreed to submit the pilot to the National Assembly for consideration and decision. He suggested that the Government take into account the opinions of the National Assembly Standing Committee and the examining body to complete the content of the submission, clarify the current situation and problems to provide for the delegates to study and discuss.
