How to practice democracy in agencies and units according to regulations?

(Chinhphu.vn) - Mr. Pham Xuan Sang (Lam Dong) asked, is Decree No. 04/2015/ND-CP dated January 9, 2015 of the Government on implementing democracy in the activities of state administrative agencies and public service units still in effect?

On this issue, the Ministry of Home Affairs responded as follows:

The Law on Implementing Democracy at Grassroots Level 2022, effective from July 1, 2023, in Chapter III, stipulates the implementation of democracy in agencies and units and inherits the content of Decree No. 04/2015/ND-CP dated January 9, 2015 of the Government on implementing democracy in the activities of state administrative agencies and public service units; at the same time, it supplements new provisions in the Law on Implementing Democracy at Grassroots Level.

Therefore, with the promulgation and effective date of the Law on Implementation of Democracy at the Grassroots Level, Decree No. 04/2015/ND-CP is no longer in effect.

After reviewing the legal provisions related to the Law on Grassroots Democracy, on May 17, 2025, the Ministry of Home Affairs issued Document No. 2498/BNV-PC proposing to abolish Decree No. 04/2015/ND-CP dated January 9, 2015 of the Government on implementing democracy in the activities of state administrative agencies and public service units. The Ministry of Justice is synthesizing and submitting to the Government the abolition of Decree No. 04/2015/ND-CP.
