UK court hears copyright case between Getty Images and Stability AI

Getty Images accuses Stability AI of illegally copying millions of images from its platform to train its text-based image-generating AI system - Stable Diffusion.

On June 9, the UK Supreme Court began hearing a copyright lawsuit between Getty Images and artificial intelligence (AI) company Stability AI, marking an important legal milestone related to the use of copyrighted data to train AI models.

Getty Images, a Seattle-based media group that provides creative images and videos , accused Stability AI of illegally copying millions of images from its platform to train its text-based image-generating AI system - Stable Diffusion.

This is a parallel lawsuit to another case Getty is pursuing in the US.

During the hearing, Getty asserted that the lawsuit was not a confrontation between technology and creativity but aimed at protecting intellectual property rights against unauthorized use of copyrighted assets.

“The two industries — creative and AI — can coexist and support each other,” said Getty attorney Lindsay Lane. “But that doesn’t mean AI companies can use copyrighted material without paying.”

Stability AI, based in London, disputed the allegations and argued that the model training process took place overseas, outside of UK jurisdiction.

The company also cited the principle of “fair use” to defend its use of copyrighted data for AI training.

Additionally, Stability argues that the lawsuit poses a threat to the growth of both the company and the AI industry as a whole.

Before the hearing, a spokesperson for Stability AI also asserted that the dispute was about innovation and creative freedom, arguing that artists using their tools were drawing on “common knowledge of humanity” – something that is considered fair and legal under the principle of fair use.

The case is one of several legal disputes emerging in the UK, US and other countries over AI companies' use of copyrighted material to train models.

Since the rise of AI tools like ChatGPT and Stable Diffusion, the creative industries have repeatedly voiced concerns about the potential erosion of artists' and authors' rights.

Experts say the lawsuit will set an important legal precedent that could shape content licensing principles in the global AI industry.

The trial has attracted special attention from both the technology and creative industries, as the world is still searching for a balance between technological innovation and intellectual property protection./.
