Ho Chi Minh City urgently directs to lift suspension of asset transactions related to Vu 'aluminum'

The Ho Chi Minh City People's Committee issued an urgent document conveying the opinion of Mr. Phan Van Mai - Chairman of the City, directing the Department of Natural Resources and Environment and the Department of Justice to coordinate in implementing the document from the Investigation Police Department of the Ministry of Public Security regarding the cancellation of the temporary suspension of asset transactions and ensuring the normal operation of companies related to Mr. Phan Van Anh Vu (aka Vu "aluminum").

The Ho Chi Minh City People's Committee requires a 15-day implementation period, starting from the date of receipt of the document.

Earlier, in early May, the Office of the Investigation Agency (C01) - Ministry of Public Security sent a document to the People's Committee of Ho Chi Minh City requesting a resolution to the above issue.

Specifically, the C01 Department stated that it is currently investigating cases of "Intentionally disclosing state secrets," "Tax evasion," "Abuse of power and authority while performing official duties," "Violation of regulations on the management and use of state assets causing losses and waste," and "Violation of regulations on land management," related to Mr. Phan Van Anh Vu, which occurred in Da Nang City.

In connection with these cases, to ensure the enforcement of the judgments, C01 has seized assets related to Mr. Vu in Ho Chi Minh City.

Specifically, the seized assets include: the land use rights at plot No. 15 Thi Sach Street, Ben Nghe Ward, District 1, with an area of ​​2,366m2, belonging to Bac Nam 79 Construction Joint Stock Company, which was granted by the Ho Chi Minh City People's Committee according to a decision dated June 11, 2015; and the land use rights, ownership of houses and other assets attached to the land at No. 8 Nguyen Trung Truc Street, Ben Thanh Ward, District 1, with an area of ​​1,297m2, granted by the Ho Chi Minh City Department of Natural Resources and Environment to Bac Nam 79 Construction Joint Stock Company on May 28, 2012.

Furthermore, on April 20, 2018, the Investigation Police Department of the Ministry of Public Security sent a document requesting the People's Committee of Ho Chi Minh City to temporarily suspend transactions of assets, including shares, stocks, real estate, property rights, etc., of individuals and organizations related to Mr. Phan Van Anh Vu, including Construction Joint Stock Company 79 and Bac Nam 79 Construction Joint Stock Company.

According to a document from Department C01, all cases related to Phan Van Anh Vu have been brought to trial and the judgments have become legally binding.

The judgments only declared the continued maintenance of the seizure orders for two assets: land use rights, ownership of houses and other assets attached to the land mentioned above; they did not order the suspension of asset transactions or the freezing of bank accounts of Construction Joint Stock Company 79, Bac Nam 79 Construction Joint Stock Company, LVC Limited Company, and Nhat Gia Phuc Joint Stock Company (all headquartered in Da Nang) to facilitate the enforcement of the judgments.

Therefore, the Investigation Agency of the Ministry of Public Security requests the People's Committee of Ho Chi Minh City to direct relevant departments and units to address the requests of the aforementioned companies regarding the cancellation of the temporary suspension of asset transactions and the freezing of bank accounts to ensure normal operations, in accordance with the law, in order to protect the legitimate rights and interests of shareholders and capital contributors.

In addition, the Investigation Department of the Ministry of Public Security has sent a document requesting the People's Committee of Ho Chi Minh City to direct relevant units to resolve the request of Ms. Nguyen Thi Thu Hien (wife of Mr. Phan Van Anh Vu) to lift the temporary suspension of transactions related to her assets in Ho Chi Minh City.

Recently, Mr. Phan Van Mai, Chairman of the People's Committee of Ho Chi Minh City, directed two relevant departments to resolve this issue.

Similarly, also stemming from a request from the Investigation Agency of the Ministry of Public Security, the Chairman of the People's Committee of Da Nang City directed relevant departments and units to resolve the issue of lifting the temporary suspension of asset transactions, ensuring the normal operation of companies related to Mr. Phan Van Anh Vu - including 9 properties with land use rights, house ownership rights, and other assets related to Mr. Phan Van Anh Vu that the Investigation Agency of the Ministry of Public Security had seized during the investigation of the cases.
