Regulation No. 377 of the Politburo recently issued clearly states the decentralization of cadre management and planning, appointment, nomination, temporary suspension, removal from office, resignation, and dismissal of cadres.
Regarding the appointment and nomination of candidates, the Politburo 's Regulations clearly state that it must be based on the standards, conditions, qualities, ethics, capacity, strengths and prestige of the cadres. This, according to the Politburo, must also come from the requirements of implementing the political tasks of the locality, agency and unit.
According to Regulation 377, competent authorities can consider, appoint, or recommend candidates for higher positions for officials who have committed violations or shortcomings; have been disciplined or are in the process of investigation, inspection, examination, or settlement of denunciations or complaints..., but must ensure standards and conditions in specific cases.

First, officials who have committed violations or shortcomings must review and learn from experience, but not to the extent that disciplinary action must be considered.
Second, cadres who have committed violations or shortcomings must review, consider responsibility, and be disciplined, but the competent authority decides not to discipline or not to issue a disciplinary decision due to the expiration of the statute of limitations (if the disciplinary action is in the form of reprimand or warning), due to direct responsibility, responsibility of the head or joint responsibility related to the matter, and have completed the review and made corrections as required.
Third, cadres are disciplined by reprimand (after 24 months); warning is not subject to dismissal or removal from office (after 36 months); or removal from office (after 60 months).
Cadres in this case, if they meet the standards and conditions and are assessed by competent authorities to have completed the review and overcome violations and shortcomings (if any); at the same time, are assessed by the Party Committees directly managing the cadres as having the qualities, capacity and ability to meet the requirements and assigned tasks, then competent authorities can consider and appoint them to a higher position and be responsible for their decisions.
Regulation 377 of the Politburo clearly states that cadres who have been disciplined by reprimand or warning and whose disciplinary period has expired but has not met the time limit prescribed above will not be considered for appointment or nomination for a higher position, but will be considered for reappointment or nomination for re-election if the cadre meets the prescribed standards and conditions.
Officials who are being disciplined in the form of reprimand cannot be appointed or recommended to run for higher positions, but each case can be carefully considered and weighed to be reappointed or recommended for re-election.
The Politburo's regulations also clearly stipulate cases where officials are temporarily not considered, reappointed, or recommended for re-election.
Officials appointed or introduced to run for higher positions must ensure general standards and specific standards of the appointed or introduced position according to regulations.
Cadres introduced from local human resources must be planned for the appointed position or be planned for an equivalent position or higher. For personnel from external sources, the Politburo requires that they must be planned for an equivalent position or higher.
Officials appointed or nominated to run for a higher position must have held the current position or equivalent position for at least 1 year (12 months).
In special cases where the term of office or equivalent position is not guaranteed, the competent authority appointing the cadre shall consider, decide and be responsible for its decision.
According to the Politburo, cadres of agencies in the political system who are proposed to be appointed to leadership and management positions (higher) for the first time must be old enough to serve a full term. In special cases, the competent authority appointing the cadres will consider, decide and be responsible for their decisions.
That officer must also be healthy enough to complete the assigned tasks.
Regulation 377 of the Politburo also clearly states that the term of appointment to a position is 5 years (60 months) for leadership and management positions in agencies and units in the political system and state-owned enterprises. The term of appointment to a position of less than 5 years applies to a number of specific positions according to separate regulations.
