Continuing the program of the August legal session, on the morning of August 14, the National Assembly Standing Committee gave opinions on explaining, accepting and revising the draft Law on Fire Prevention, Fire Fighting and Rescue.
The report on some major issues of the draft Law on Fire Prevention, Fire Fighting and Rescue presented by the Chairman of the National Defense and Security Committee, Lieutenant General Le Tan Toi, showed that, compared to the draft Law submitted to the National Assembly at the 7th Session, the draft Law on Fire Prevention, Fire Fighting and Rescue has been revised to include 9 chapters and 61 articles, reducing 4 articles due to the revision and merging of similar provisions; regulations on fire prevention, fire fighting, rescue, forces, means, ensuring operating conditions and rights, obligations and responsibilities of relevant agencies, organizations and individuals in fire prevention, fire fighting, rescue and rescue activities.
After receiving and revising the draft law, there was basically consensus between the reviewing agency and the drafting agency. Regarding the scope of the law, there were opinions suggesting revising the scope of the law to ensure coverage and compatibility with the contents of the draft law; reviewing the contents of the draft law to avoid overlapping with the provisions of current laws; proposing to supplement the responsibilities of agencies, organizations, individuals, households and the responsibility of the whole society for fire prevention, fire fighting and rescue work; supplementing the content of state management of fire prevention, fire fighting and rescue.
In response to the opinions of the National Assembly deputies, the Standing Committee of the National Defense and Security Committee coordinated with the drafting agency to carefully review the content of the draft law with the provisions of current laws as well as the laws recently passed by the National Assembly at the 7th Session; researched and supplemented the relevant contents of the draft law to ensure comprehensiveness and compatibility between the provisions in Article 1 on the scope of regulation and the provisions of the draft law.
At the same time, the Standing Committee of the National Defense and Security Committee also added specific regulations to raise awareness and skills in fire prevention, fire fighting, and rescue of the community through the contents of regulations on State policies (Article 4); regulations on the responsibility for disseminating andeducating knowledge and laws on fire prevention, fire fighting, and rescue (Article 8) and regulations on responsibilities in state management for the Government, ministries, branches, People's Committees at all levels (Article 56), as well as for agencies, organizations and individuals in specific related articles in the draft law.
Discussing at the meeting, the majority of opinions of the National Assembly Standing Committee members agreed to accept and revise the draft law.
National Assembly Chairman Tran Thanh Man stated that this is a very important law project, affecting the socio-economic life, lives, and property of people and businesses... Therefore, it needs to be further studied carefully, reviewed closely and urgently to overcome shortcomings and limitations, especially in the context of recent major fires that have caused a lot of damage to people and property.
After being revised, the draft law now stipulates a separate article on fire prevention for residential houses and a separate article on fire prevention for residential houses combined with business houses. Notably, the addition of regulations for these two types of houses aims to ensure requirements on safety conditions for fire prevention, fire fighting, and escape.
However, at the meeting, members of the National Assembly Standing Committee pointed out that the regulations are still general and difficult to implement for law enforcement agencies and people.
Vice Chairman of the National Assembly's Law Committee Nguyen Truong Giang analyzed: "We stipulate that there must be fire alarms, ventilation solutions, and gas and toxic gas leak alarms according to regulations. The problem is who regulates this is unclear. Second, street-front houses are all combined with business, this is a very popular type nowadays, especially in urban areas. If there are no specific regulations, it should be assigned to the Government or the Minister of Public Security to regulate."
Many opinions at the meeting also expressed concern about the complexity of fire prevention and fighting in high-rise buildings.
According to Chairman of the National Assembly's Committee on Culture and Education Nguyen Dac Vinh, there should be detailed regulations on methods and means of fire prevention and fighting for high-rise buildings, because this is an area with a large concentration of people and high terrain, so fire fighting, rescue and relief plans that must be implemented will be more complicated and difficult.
In addition, the opinions of the members of the National Assembly Standing Committee also highly appreciated the draft law for covering regulations on ensuring fire prevention and fighting safety in the installation and use of electricity for daily life and production to ensure feasibility and non-overlapping with current legal regulations; regulations on inspection and examination of fire prevention and fighting work, especially self-inspection by localities, agencies, units, organizations, etc.
Also at the meeting, delegates gave their opinions on explaining, accepting and revising the draft Law on Value Added Tax (amended).
