Resolution No. 30/2025/NQ-HĐND, issued on August 28, 2025, takes effect from September 1, 2025. Recently, the People's Committee of Ho Chi Minh City issued Official Letter No. 1613/UBND-VX dated September 8, 2025, regarding the implementation of Resolution No. 30/2025/NQ-HĐND. The Department of Education and Training of Ho Chi Minh City also issued Official Letter No. 2819/SGDĐT-GDMN dated September 30, 2025, on the implementation of the above Resolution.

However, during the implementation process, some wards/communes still encountered difficulties and obstacles. Based on this, the Ho Chi Minh City Department of Education and Training issued a document to clarify and answer the difficulties and questions of the wards and communes regarding the implementation of Resolution No. 30/2025/NQ-HĐND issued on August 28, 2025, by the Ho Chi Minh City People's Council, which stipulates the policy for developing preschool education in areas with industrial parks and a large workforce in the city.

What is the legal basis for determining areas with a high labor demand?

The Ho Chi Minh City Department of Education and Training stated that the legal basis for determining a place with a large workforce is based on Government Decree No. 145/2020/ND-CP dated December 14, 2020, which details and guides the implementation of several articles of the Labor Code on working conditions and labor relations (Decree No. 145/2020/ND-CP). According to Clauses 1 and 2 of Article 75, "a place with a large workforce" is defined as follows:

  1. Industrial parks, industrial clusters, export processing zones, economic zones, and high-tech zones (hereinafter referred to as industrial parks) have 5,000 or more workers employed in enterprises within the industrial park and participating in social insurance contributions.
  2. Communes, wards, and towns with 3,000 or more workers registered as permanent or temporary residents in that commune, ward, or town.

According to point b, clause 5, Article 87 of Decree No. 145/2020/ND-CP, the Provincial People's Committee is responsible for "Reviewing and identifying areas with a large number of laborers and organizing the implementation of the regulations in Article 81 of this Decree".

Therefore, "Currently, the Ho Chi Minh City Department of Education and Training has coordinated with the Management Board of Export Processing Zones and Industrial Parks of the city, and the Department of Industry and Trade to provide a list of industrial parks, export processing zones, high-tech zones and industrial clusters, and has submitted a report to the City People's Committee on reviewing and identifying areas with a large workforce in Ho Chi Minh City," the Ho Chi Minh City Department of Education and Training stated.

A question has been raised by Phu Dinh ward, Ho Chi Minh City: Resolution No. 30/2025/NQ-HĐND stipulates support for preschool teachers working in nurseries and kindergartens with a large workforce. Does this also apply to preschool teachers working in kindergartens and preschools with a large workforce?

In response to this question, the Ho Chi Minh City Department of Education and Training replied: According to Clause 4, Article 81 of Decree No. 145/2020/ND-CP: "Preschool teachers working in nurseries and kindergartens." Private and non-public preschools located in areas with a large workforce are entitled to the same policies applied to preschool teachers working at private and non-public preschools in industrial zones as stipulated in Article 10 of Government Decree No. 105/2020/ND-CP dated September 8, 2020, on policies for the development of preschool education.

According to Clauses 1, 2, and 3 of Article 77 of Decree No. 145/2020/ND-CP, "Nursery school, kindergarten class" is a preschool education facility as prescribed in Article 26 of the Law on Education, including: (1) Independent nurseries and children's groups that accept children from 3 months old to 3 years old; (2) Independent kindergartens and kindergarten classes that accept children from 3 years old to 6 years old; (3) Independent kindergartens and kindergarten classes that are educational facilities combining nurseries and kindergartens, accepting children from 3 months old to 6 years old.

At the same time, Clause 2, Article 1 of Resolution No. 30/2025/NQ-HĐND stipulates that the beneficiaries of the policy are (a) the subjects specified in Clause 1, Article 5, Clause 1, Article 8 and Clause 1, Article 10 of Decree No. 105/2020/NĐ-CP regulating the policy on the development of preschool education; and (b) the subjects specified in Clauses 2, 3 and 4, Article 81 of Decree No. 145/2020/NĐ-CP detailing and guiding the implementation of some articles of the Labor Code on working conditions and labor relations.

Therefore, it can be understood that Resolution No. 30/2025/NQ-HĐND provides support for preschool teachers working in kindergartens and preschools with a large workforce.

Support levels for children, teachers, and preschool facilities.

Resolution No. 30/2025/NQ-HĐND takes effect from September 1, 2025. Preschool children of workers and laborers working in industrial zones or areas with a large workforce will receive support of 240,000 VND/child/month, for no more than 9 months/school year.

Preschool teachers working at private preschools in industrial zones, and preschool teachers working in nurseries and kindergartens with a large workforce, will receive a support payment of 1 million VND per person per month, for a maximum of 9 months per school year. This support payment is separate from the agreed-upon salary between the owner of the private preschool and the teacher and is not used for calculating social insurance, health insurance, and unemployment insurance contributions.

Independent preschools located in industrial zones and kindergartens/preschools in areas with a high concentration of workers that have fewer than 30 children will receive a subsidy of 35 million VND.

Independent preschools located in industrial zones, and kindergartens/preschools in areas with a high concentration of workers, with 30 to under 50 children, will receive a subsidy of 55 million VND.

Independent preschools located in industrial zones and kindergartens/preschools in areas with a high concentration of workers, with 50 to 70 children, will receive a subsidy of 70 million VND. Kindergartens, preschools, and preschools in areas with a high concentration of workers and with more than 70 children will receive a subsidy of 70 million VND.
