The United States initiated an administrative review of anti-dumping duties on some Vietnamese export products.

The United States initiates a sunset review of uninsulated spring mattress products from Vietnam. The United States issues its final conclusion in the final review of woven bags from Vietnam.

On the afternoon of October 1, 2024, the Trade Remedies Department of the Ministry of Industry and Trade announced that the US Department of Commerce (DOC) had published a notice initiating an administrative review of several Vietnamese export products currently subject to anti-dumping duties, including:

Frozen Pangasius/Basa fish fillets: Case code: A-552-801 (CBPG), review period: August 1, 2023 - July 31, 2024.

Raw honey: Case code: A-552-833 (CBPG); Review period: June 1, 2023–May 31, 2024.

Seamless Refined Copper Pipe and Tube: Case Code: A-552-831 (CBPG); Review Period: August 1, 2023 - July 31, 2024.

According to U.S. law, within 35 days of the notice initiating the review (expected October 25, 2024), the U.S. Department of Commerce will select companies to be mandatory respondents in the cases based on their export volume, from highest to lowest, according to data from the U.S. Customs and Border Protection (CBP) or the Quantity and Value (Q&V) questionnaire responses from the exporting companies.

The Trade Remedies Bureau notes that the U.S. Department of Commerce will not aggregate exports from affiliated companies to select mandatory respondents unless the Department of Commerce has previously decided to do so in a prior investigation/review within the framework of that case.

According to regulations, if a manufacturing/exporting company is named in the review list in the initiation notice but does not have export activities during the review period, the company must notify the U.S. Department of Commerce within 30 days of the publication of the review initiation notice (expected October 20, 2024) so ​​that the U.S. Department of Commerce can consider how to proceed. Additionally, within 90 days of the publication of the initiation notice, parties may withdraw their review request (expected December 19, 2024). The U.S. Department of Commerce may extend this 90-day period depending on the case.

In addition, for countries that the United States considers non-market economies , such as Vietnam, in order to benefit from the individual tax rate, businesses must simultaneously answer the Q&V questionnaire (within the required deadline) and submit an application for the individual tax rate within 30 days of the date of the notice initiating the review (expected October 20, 2024).

The application form for an individualized tariff rate is available from the U.S. Department of Commerce at the following link: https://access.trade.gov/Resources/nme/nme-sep-rate.html. If a business does not apply for an individualized tariff rate and is not selected as a mandatory respondent, it will be subject to the nationwide tariff rate (usually the higher rate).

The U.S. Department of Commerce expects to issue its final conclusion on the review no later than August 31, 2025.

To ensure the legitimate interests of businesses, the Trade Remedies Department recommends that businesses producing/exporting related products participate in the review process if necessary to change the applied anti-dumping duties, fully comply with the requirements of the US investigating authority, regularly monitor the developments of the case, and closely cooperate with the Trade Remedies Department throughout the process to receive timely advice and support.
