(GLO) - From July 1st, the Government issued Decree 39/2023/ND-CP detailing some provisions of Resolution No. 73/2022/QH15 dated November 15, 2022, of the National Assembly on piloting the auction of automobile license plates. According to the Decree, the list of automobile license plates to be auctioned must be publicly disclosed at least 30 days before the auction date.
Decree 39/2023/ND-CP clearly states that participants in the auction are Vietnamese organizations and individuals who meet the eligibility requirements for auctioning vehicle license plates as stipulated in this Decree and other relevant laws. The auction of vehicle license plates is conducted online and must comply with the laws on asset auctions and cybersecurity.
The Minister of Public Security decides the number of license plates to be auctioned at each auction session, including license plates for provinces and centrally-administered cities, with serial numbers: A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y, Z, white background, black letters and numbers, not yet registered, expected to be newly issued, currently in the Ministry of Public Security's vehicle registration and management system, and supplementing the number of license plates for the Public Security departments of provinces and centrally-administered cities in case they run out of license plates for registration before the next auction session.

The Ministry of Public Security transfers the list of car license plates to be auctioned to the property auction organization, and at the same time publicly announces the list and plan for organizing the auction of car license plates on the Ministry of Public Security's electronic information portal, the Traffic Police Department's electronic information portal, with a link to the property auction organization's online auction information page.
The property auction organization shall publicly announce the list of license plates of cars put up for auction on the national property auction information portal, the property auction organization's online auction information page and post it at its headquarters. The auction regulations must be posted and publicly announced on the online auction information page and the property auction organization's headquarters.
According to the Decree, the public announcement, posting of the auction regulations, and list of license plates to be auctioned must be done at least 30 days before the auction date.
Conditions for registering to participate in the auction include: Being eligible to participate in the auction as mentioned above and paying a deposit to the asset auction organization as stipulated in Clause 2, Article 3 of Resolution No. 73/2022/QH15; Organizations and individuals registering to participate in the auction are solely responsible for the accuracy and truthfulness of the information declared during registration.
The decree also stipulates the deposit for participating in the auction. Specifically, the deposit must be deposited into a separate payment account of the asset auction organization opened at a bank from the time of registration until 3 days before the auction. In case of a successful bid, the deposit will be transferred to the Ministry of Public Security's dedicated collection account to be paid into the state budget as prescribed.
Within 7 working days from the date of receiving the auction results, auction minutes, and list of winning bidders from the asset auction organization, the Ministry of Public Security shall issue a document approving the auction results.
The Ministry of Public Security shall send the notification of the winning auction results of the car license plate to the email address and send a notification message to the phone number registered in the access account to the auction winner immediately after approving the auction results; the notification of the winning auction results of the car license plate replaces the contract for the sale of auctioned assets or the contract for the sale of state assets.
According to the Decree, the content of the auction results notification includes: the license plate number of the winning car, the name and identification code of the individual or organization (if the organization has not been issued an identification code, the tax code or the establishment decision number of the organization should be recorded), the address of the winning bidder, the winning bid price, the amount to be paid, the dedicated account number opened by the Ministry of Public Security at a bank or foreign bank branch for depositing the winning bid amount, the deadline for paying the winning bid amount, and the cancellation of the auction results if the full winning bid amount is not paid as stipulated.
Within 15 days from the date of announcement of auction results, the auction winner must pay the entire auction winning amount after deducting the deposit into the Ministry of Public Security's specialized collection account opened at a bank or foreign bank branch. The auction winning amount does not include vehicle registration fees.
Immediately after receiving the full auction price, the Ministry of Public Security will issue an electronic invoice for the sale of public assets and an electronic document confirming the winning bid for the vehicle license plate, which will be sent to the winning bidder's email address for vehicle registration procedures. The pilot program for auctioning vehicle license plates as stipulated in this Decree will be implemented from July 1, 2023 to July 1, 2026.
