Decree 235: Timely adjustment for industrial promotion activities

The Ministry of Industry and Trade will soon issue circulars guiding Decree 235/2025/ND-CP so that localities can effectively implement industrial promotion activities for 2026 and the 2026-2030 period.

After 12 years of implementing Decree No. 45/2012/ND-CP of the Government on industrial promotion, many positive results have been achieved, contributing to promoting the industrialization and modernization of rural agriculture ; supporting rural industrial establishments to develop production, apply advanced technology, promote internal resources and effectively exploit local potential.

However, in the face of changes in administrative organization, the trend of developing green economy, circular economy and digital economy, many provisions of Decree No. 45 have revealed many limitations, no longer suitable to practical requirements. The Ministry of Industry and Trade has directed the review and research of amendments to perfect the legal framework, increase feasibility, encourage innovation and digital transformation in industrial promotion activities.

On that basis, the Government issued Decree No. 235/2025/ND-CP dated August 27, 2025 amending and supplementing a number of articles of Decree No. 45, effective from October 15, 2025 (Decree 235).

According to Mr. Hoang Xuan Phong, Director of Thanh Hoa Industry and Trade Promotion Center, the issuance of Decree No. 235 is a timely adjustment step, ensuring that industrial promotion policies are more suitable to the requirements of rural industrial development in the new period.

Decree No. 235 applies to all localities and expands the beneficiaries, including small and medium enterprises, cooperatives, business households, folk artisans and excellent artisans; at the same time, it provides additional support for establishments applying cleaner production, sustainable consumption, and enterprises investing in industrial cluster infrastructure. Industries are expanded to high-tech industry, clean industry, energy saving, and environmental friendliness, along with traditional fields such as agricultural, forestry and fishery processing, mechanics, textiles, and footwear.

Decree No. 235 also diversifies the support content, such as: Vocational training linked to actual needs, building technical demonstration models, applying new technologies, digital transformation, trade promotion and preserving traditional crafts. Regarding implementation, the Decree clarifies the responsibilities of management levels, abolishes inappropriate regulations, and ensures that approved projects are implemented stably. "In the context of the difficult situation of industrial and handicraft production in the province due to the global economic downturn and fluctuations in international trade, the issuance of Decree No. 235 is considered an important solution to remove obstacles and promote sustainable rural industrial development," said Mr. Phong.

Appreciating Decree 235, the Departments of Industry and Trade in the Central Highlands region hope that the Ministry of Industry and Trade will soon issue a Circular guiding its implementation.

According to Mr. Duong Minh Duc, Director of the Department of Industry and Trade of Gia Lai province, to facilitate industrial promotion activities in 2026 and the coming time, the Department proposed that the Ministry of Industry and Trade coordinate with the Ministry of Finance to consider supplementing regulations on industrial promotion activity expenditure levels according to new support contents to replace the instructions in Circular No. 28/2018/TT-BTC dated March 28, 2018 (amended and supplemented by Circular No. 64/2024/TT-BTC dated August 28, 2024) to comply with Decree 235.

Discussing these contents, Ms. Do Thi Minh Tram, Deputy Director of the Department of Innovation, Green Transformation and Industrial Promotion (Ministry of Industry and Trade) said that the Ministry of Industry and Trade has assigned the Department of Innovation, Green Transformation and Industrial Promotion to preside over reviewing and developing a plan to amend the Circulars guiding industrial promotion to comply with the law on local government organization, other relevant laws and implementation practices in 2026.

After the Government issued Decree No. 235/2025/ND-CP dated August 27, 2025 amending and supplementing Decree No. 45/2012/ND-CP dated May 21, 2012 of the Government on industrial promotion, the Ministry of Industry and Trade and the Ministry of Finance are reviewing and researching to amend and supplement guiding Circulars to synchronize the system of legal documents on industrial promotion work, creating favorable conditions for localities to apply and implement.

“In 2026, the Department of Innovation, Green Transformation and Industrial Promotion will coordinate with the Department of Sectoral Economics (Ministry of Finance) to amend Circular No. 28 and Circular 64 of the Ministry of Finance on establishing expenditure levels, based on the new expenditure levels of Decree 235” , Ms. Tram affirmed and added that for the Circulars related to activities issued by the Ministry of Industry and Trade, it is expected that in the first quarter of 2026, the Department will submit to the Minister of Industry and Trade to issue new circulars to comply with Decree 235 and the circular of the Ministry of Finance that is about to be issued.

With the efforts from the Ministry of Industry and Trade, the Department of Innovation, Green Transformation and Industrial Promotion, Resolution 235 is expected to soon come into practice, increasing the effectiveness of industrial promotion activities in the new context after the arrangement of administrative units and operation according to the two-level local government model.

It is expected that on December 10, in Ho Chi Minh City, the Department of Innovation, Green Transformation and Industrial Promotion will organize a conference to disseminate new contents of industrial promotion activities in Decree 235 as well as the national industrial promotion program for the period 2026 - 2030. Representatives of the Ministry of Finance, the Department of Innovation, Green Transformation and Industrial Promotion will share, exchange and guide localities on related contents in the process of implementing the Project as well as advances, settlement and expenditure contents and levels for industrial promotion.
