
According to the Ministry of Education and Training , the current system of legal documents regulating the activities of general education schools is fragmented and cumbersome. With the transition to a two-tiered local government model and the policy of streamlining the administrative apparatus and procedures, and promoting digital transformation, some content in these documents is no longer suitable. This reality necessitates unifying the current documents into a new legal document that is consistent with existing laws and regulations.
The draft of the new Circular comprises 8 Chapters and 47 Articles, adding and adjusting several notable contents. Specifically, the draft adds boarding schools and other gifted schools to the regulations on school types and the general education school system; and the organization of specialized education. It also changes the educational management functions of the District People's Committee and the Department of Education and Training to the responsibilities of the Commune People's Committee and the Department of Culture and Social Affairs. This change is consistent with the policy of "Focusing on perfecting legal regulations to promptly remove bottlenecks, obstacles, mechanisms, and policies" and "promoting decentralization and delegation of power" as outlined in Resolution No. 71-NQ/TW dated August 22, 2025, of the Politburo on breakthroughs in education and training development.
The draft Circular also clearly defines the powers and responsibilities of school administrators, teachers, and staff; at the same time, it omits the regulation on granting junior high school graduation certificates to fulfill compulsory education tasks at the junior high school level; it omits the regulation on textbook selection; and it omits the regulation on the School Council for public schools. These omitted regulations aim to ensure consistency with the provisions of the Law amending and supplementing certain articles of the Law on Education and the Law on Teachers.
To adapt to digital transformation, the draft Circular specifically regulates the digitalization of school records. Electronic records will be used to replace paper records according to a roadmap that suits the conditions of the locality, the school, the teachers' capabilities, and ensures the legality of electronic records. Record management will be regulated by the Department of Education and Training according to the connection and data standards of the Ministry of Education and Training.
At the same time, to minimize administrative procedures for parents and students, the draft Circular stipulates that school transfers and student admissions will be carried out on the Public Service Portal. In cases where it is not possible to submit applications and declare information for school transfers, admissions, or re-admissions on the Public Service Portal, students or their parents/guardians must submit applications for school transfers, admissions, or re-admissions to the receiving school in person, online, or via mail.
The draft Circular also stipulates the duties, powers, professional standards, and requirements for continuous professional development of teachers. These regulations contribute to improving the quality of the teaching staff, increasing professionalism, responsibility, and transparency in the performance of professional duties. At the same time, the draft Circular ensures the full legal rights of teachers and staff, helping them feel secure in their work; improving the quality of education, strengthening public trust in the teaching staff; and introducing regulations on conduct, preventing school violence, and preventing violations of professional ethics in schools to build a safe, healthy, and humane educational environment.
Furthermore, the draft Circular also specifies standards for facilities, teaching equipment, libraries, and quality assurance conditions to create motivation for investment and modernization of schools; ensure safety, reduce waste, and improve the efficiency of using public assets.
The mechanism for coordinating family, school, and society is included in the draft Circular to create conditions for parents, social organizations, and the community to participate in the educational process; strengthen social supervision, mobilize resources for educational activities, prevent risks, and support students' holistic development.
