Hoa Phat steel pipes were not subject to US anti-dumping duties in the circumvention investigation.
This information is from the final conclusion notice issued by the U.S. Department of Commerce (DOC) regarding the administrative review of the anti-dumping (AD) and countervailing duty (CVD) circumvention investigation into steel box sections (LWRPT) imported from China into the United States.
Hoa Phat participated in this administrative review to demonstrate that the base steel used to manufacture steel pipe products exported to the United States during the review period (2022-2023) originated from Vietnam. Accordingly, Hoa Phat's steel pipe shipments are not subject to anti-dumping duties, the same duties the United States previously imposed on Hoa Phat in the 2022 circumvention investigation.
According to the DOC's conclusion, Hoa Phat used hot-rolled steel coils of Vietnamese origin for LWRPT shipments during the review period. Therefore, Hoa Phat is eligible to participate in the self-certification process for future export shipments, effective from May 5, 2025.
Within 35 days of the aforementioned final conclusion, the DOC will send instructions to the U.S. Customs and Border Protection (CBP) to process the clearance of shipments without collecting the deposit. The DOC's decision facilitates Hoa Phat Steel Pipe Company's efforts to boost steel pipe exports to the U.S. market in the near future.
This is a success for Hoa Phat in its close cooperation and proactive provision of all relevant data to the US investigating authorities. Transparent data and a clear system are among the factors contributing to Hoa Phat's success in this case.
Previously, in 2016, the United States International Trade Commission (USITC) also decided not to impose anti-dumping duties on carbon steel pipes from Vietnam to the United States.
